  1                      A bill to be entitled

  2         An act relating to the permitting authority for

  3         piers or associated structures; amending s.

  4         403.814, F.S.; prohibiting the Department of

  5         Environmental Protection from delegating

  6         general permit authority to the Southwest

  7         Florida Water Management District for the

  8         construction, extension, or removal of piers or

  9         associated structures; reassigning to the

10         department the authority to act on pending

11         applications for a permit; rescinding a prior

12         delegation of authority by the department to

13         that district; providing an effective date.

15  Be It Enacted by the Legislature of the State of Florida:

16  

17         Section 1.  Subsection (4) of section 403.814, Florida

18  Statutes, is amended to read:

19         403.814  General permits; delegation.--

20         (4)  The department is authorized to delegate any of

21  its general permit authority to the district offices of the

22  department or to water management districts. However, the

23  department may not delegate authority to issue a general

24  permit for construction, extension, or removal of a pier or

25  associated structures within the Southwest Florida Water

26  Management District to that district.  Any general permit

27  application for the construction, extension, or removal of a

28  pier or associated structures within the Southwest Florida

29  Water Management District which is pending on July 1, 2004, is

30  reassigned to the department and any authority delegated to

 1  the Southwest Florida Water Management District before July 1,

 2  2004, to issue such general permits is rescinded.

 3         Section 2.  This act shall take effect July 1, 2004.

 6                          SENATE SUMMARY

 7    Removes the authority of the Department of Environmental
      Protection to delegate general permitting authority for
 8    the construction, extension, or removal of a pier or
      associated structures to the Southwest Florida Water
 9    Management District.  Reassigns the authority to issue
      pending applications for such pier or structures to the
10    department.  Rescinds the prior delegation by the
      department for such permits to that district.
