1 A bill to be entitled
2 An act relating to the delegation of general
3 permit authority for piers or associated
4 structures; amending s. 403.814, F.S.;
5 prohibiting the Department of Environmental
6 Protection from delegating general permit
7 authority to the water management districts for
8 the construction, extension, or removal of
9 piers or associated structures; reassigning to
10 the department the authority to act on pending
11 applications for a permit; rescinding a prior
12 delegation of authority by the department to
13 the districts; providing an effective date.

15 Be It Enacted by the Legislature of the State of Florida:

17 Section 1. Subsection (4) of section 403.814, Florida
18 Statutes, is amended to read:
19 403.814 General permits; delegation.--
20 (4) The department is authorized to delegate any of
21 its general permit authority to the district offices of the
22 department or to water management districts. However, the
23 department may not delegate authority to issue a general
24 permit for construction, extension, or removal of a pier or
25 associated structures to any water management district. Any
26 general permit application for the construction, extension, or
27 removal of a pier or associated structures which is pending in
28 any water management district on July 1, 2004, is reassigned
29 to the department and any authority to issue such general
30 permits delegated to any water management district prior to
31 July 1, 2004, is rescinded.

1 Section 2. This act shall take effect July 1, 2004.

6 The committee substitute expands the application of the
delegation rescission to include all of the water management
7 districts.
