1 A bill to be entitled
2 An act relating to state university student
3 athletic fees; amending s. 1009.24, F.S.;
4 authorizing a fee increase to defray the costs
5 of changing competitive divisions; providing
6 that the increase may exceed the limit on fee
7 increases; limiting such an increase to not
8 more than $2 per credit hour; requiring that
9 such an increase be approved by the athletic
10 fee committee; providing that the increase may
11 not be included in calculating the amount a
12 student receives for certain scholarship
13 programs; providing an effective date.

15 Be It Enacted by the Legislature of the State of Florida:

17 Section 1. Subsection (3) of section 1009.24, Florida
18 Statutes, is amended to read:
19 1009.24 State university student fees.--
20 (3) Within proviso in the General Appropriations Act
21 and law, each board of trustees shall set university tuition
22 and fees. The sum of the activity and service, health, and
23 athletic fees a student is required to pay to register for a
24 course shall not exceed 40 percent of the tuition established
25 in law or in the General Appropriations Act. No university
26 shall be required to lower any fee in effect on the effective
27 date of this act in order to comply with this subsection.
28 Within the 40 percent cap, universities may not increase the
29 aggregate sum of activity and service, health, and athletic
30 fees more than 5 percent per year unless specifically
31 authorized in law or in the General Appropriations Act. A

1 university that changes National Collegiate Athletic
2 Association divisions may increase its athletic fee at the
3 time the university is in the transitional stage of changing
4 divisions to defray the costs associated with changing
5 divisions. Such an increase in the athletic fee is exempt from
6 the 40-percent cap and the 5-percent cap on yearly increases
7 in the sum of the activity and service, health, and athletic
8 fees, but may not exceed $2 per credit hour of registered
9 classes. Such an increase must be approved by the athletic fee
10 committee as provided in subsection (11). Notwithstanding ss.
11 1009.534, 1009.535, and 1009.536, any increase to an athletic
12 fee to defray the costs associated with changing National
13 Collegiate Athletic Association divisions which is assessed
14 pursuant to this subsection may not be included in calculating
15 the amount a student receives for a Florida Academic Scholars
16 award, a Florida Medallion Scholar award, or a Florida Gold
17 Seal Vocational Scholars award. This subsection does not
18 prohibit a university from increasing or assessing optional
19 fees related to specific activities if payment of such fees is
20 not required as a part of registration for courses.
21 Section 2. This act shall take effect upon becoming a
22 law.
