1 Senate Memorial No. ____
2 A memorial to the Congress of the United
3 States, urging Congress to explore the
4 feasibility of accessing pension plans and
5 retirement funds, both public and private, for
6 the purpose of collecting child support
7 payments and related costs and fees from moneys
8 that would ordinarily be payable only upon
9 retirement.

11 WHEREAS, the collection of child support from deadbeat
12 parents is an expensive, time-consuming, and difficult
13 process, and
14 WHEREAS, past and current income from pension plans and
15 other retirement funds is considered income for purposes of
16 child support, and
17 WHEREAS, the state has the authority to use income
18 deduction orders to access this income, and
19 WHEREAS, many deadbeat parents are eligible to receive
20 income from pension plans and retirement funds, both public
21 and private, upon retirement, and
22 WHEREAS, income from moneys payable only upon
23 retirement is not currently accessible for the purpose of
24 child support payments and related costs and fees, and
25 WHEREAS, the Congress of the United States would be
26 doing a great service to many dependent children in this
27 country by determining the feasibility of accessing pension
28 plans and retirement funds, both public and private, for the
29 purpose of collecting child support payments and related costs
30 and fees from moneys that would ordinarily be payable only
31 upon retirement, NOW, THEREFORE,

1 Be It Resolved by the Legislature of the State of Florida:

3 That the Congress of the United States is requested to
4 determine the feasibility of accessing pension plans and
5 retirement funds, both public and private, for the purpose of
6 collecting child support obligations, to include all fees and
7 costs associated with such collections, from moneys that would
8 ordinarily be payable only upon retirement.
9 BE IT FURTHER RESOLVED that copies of this memorial be
10 dispatched to the President of the United States, to the
11 President of the United States Senate, to the Speaker of the
12 United States House of Representatives, and to each member of
13 the Florida delegation to the United States Congress.
