1 A bill to be entitled
2 An act relating to electronic voting systems;
3 creating s. 101.56085, F.S.; requiring each
4 electronic voting system in the state to
5 produce a voter-verified paper record suitable
6 for a manual audit; requiring that the voter be
7 permitted to verify the correctness of the
8 printed ballot; requiring an electronic voting
9 system to produce a permanent paper record that
10 is available for inspection and verification by
11 the voter and preserved for later use in a
12 manual audit; providing that the permanent
13 paper record is the official record; providing
14 that a voting system may not use any wireless
15 communication device; providing an effective
16 date.

18 Be It Enacted by the Legislature of the State of Florida:

20 Section 1. Section 101.56085, Florida Statutes, is
21 created to read:
22 101.56085 Electronic voting machines; requirements.--
23 (1) Beginning July 1, 2005, each touch screen or other
24 electronic voting machine used in this state shall provide for
25 verification of voters and the capability of being audited.
26 (2) Any electronic voting system in this state must
27 produce a voter-verified paper record suitable for a manual
28 audit that is equivalent or superior to that of a paper ballot
29 box system. A voter must be able to view and verify the
30 correctness of his or her printed ballot. The printed ballot
31 shall be deposited or dispensed into a ballot box. A voter may

1 not retrieve the printed ballot once he or she leaves the
2 polling place.
3 (3) Any electronic voting system in this state shall
4 produce a permanent paper record. Each paper record shall be
5 made available for inspection and verification by the voter at
6 the time the vote is cast and preserved within the polling
7 place in the manner in which all other paper ballots are
8 preserved within the polling place on election day for later
9 use in any manual audit. The voting system must provide the
10 voter with an opportunity to correct any error made by the
11 system before the permanent record is preserved for use in any
12 manual audit. The voter-verified paper record is the official
13 record and must be used for any recount conducted with respect
14 to any election in which the system is used.
15 (4) A voting system may not include any wireless
16 communication device.
17 Section 2. This act shall take effect upon becoming a
18 law.
