1 A bill to be entitled
2 An act relating to greyhound racing; amending
3 s. 550.2415, F.S.; requiring the Division of
4 Pari-mutuel Wagering in the Department of
5 Business and Professional Regulation to
6 maintain certain records regarding injuries and
7 the disposition of greyhounds; providing
8 guidelines and requirements for injury and
9 disposition report forms; providing for the
10 adoption of rules; providing penalties;
11 providing an effective date.

13 Be It Enacted by the Legislature of the State of Florida:
14
15 Section 1. Subsection (6) of section 550.2415, Florida
16 Statutes, is amended to read:
17 550.2415 Racing of animals under certain conditions
18 prohibited; penalties; exceptions.--
19 (6)(a) It is the intent of the Legislature that
20 animals that participate in races in this state on which
21 pari-mutuel wagering is conducted and animals that are bred
22 and trained in this state for racing be treated humanely, both
23 on and off racetracks, throughout the lives of the animals.
24 (b) The division shall, by rule, establish the
25 procedures for euthanizing greyhounds. However, a greyhound
26 may not be put to death by any means other than by lethal
27 injection of the drug sodium pentobarbital. A greyhound may
28 not be removed from this state for the purpose of being
29 destroyed.
30 (c) It is a violation of this chapter for an
31 occupational licensee to train a greyhound using live or dead

1 animals. A greyhound may not be taken from this state for the
2 purpose of being trained through the use of live or dead
3 animals.
4 (d) A conviction of cruelty to animals pursuant to s.
5 828.12 involving a racing animal constitutes a violation of
6 this chapter.
7 (e) The division shall maintain accurate records and
8 statistics regarding injuries incurred by greyhounds that race
9 in this state. The division shall adopt rules requiring the
10 reporting of injuries incurred by greyhounds while racing in
11 this state, including schooling races. Such reports must
12 include:
13 1. The greyhound's registered name and right and left
14 ear tattoo numbers.
15 2. The name, business address, and telephone number of
16 the greyhound owner, trainer, and kennel operator.
17 3. The color, weight, and sex of the greyhound.
18 4. The specific type of injury, the cause of the
19 injury, the estimated recovery time, and the location of the
20 injury on the greyhound.
21 5. Where the injury occurred, whether on a racing
22 track or in another area.
23 6. If the injury occurred while the greyhound was
24 racing, the racetrack where the injury occurred; the distance,
25 grade, race, and post position when the injury occurred; and
26 the weather conditions, time, temperature, and track condition
27 at the time of the injury.
28 7. A certification by the racetrack veterinarian that
29 the form is correct.
30 (f) The division shall maintain accurate records and
31 statistics regarding the disposition of greyhounds that

1 participate in racing in this state. The division shall adopt
2 rules requiring the reporting of the disposition of greyhounds
3 that race in this state, including schooling races. As used in
4 the reporting requirement, the term "disposition" means death,
5 transfer to another jurisdiction, retirement, adoption, sale,
6 or donation for medical research or another purpose. Such
7 reports must include:
8 1. The greyhound's registered name and right and left
9 ear tattoo numbers; the name, business address, and telephone
10 number of the greyhound owner, trainer, and kennel operator;
11 and the name and address of the race track where the greyhound
12 last raced prior to disposition.
13 2. If the greyhound was transferred to another track,
14 the name and address of the track that received the greyhound
15 and the name, business address, telephone number, and driver's
16 license number and state of issuance of the person who
17 received the greyhound on behalf of that track.
18 3. If the greyhound was retired for breeding, the name
19 and address of the facility that received the greyhound and
20 the name, business address, telephone number, and driver's
21 license number and state of issuance of the person who
22 received the greyhound on behalf of that facility.
23 4. If the greyhound was adopted or placed for
24 adoption, the name and address of the person that received the
25 greyhound and, if applicable, the name, business address,
26 telephone number, and driver's license number and state of
27 issuance of the person who received the greyhound on behalf of
28 the adoption facility.
29 5. If the greyhound was euthanized, the name, address,
30 professional title, professional affiliation of the person

1 performing the euthanasia, method of euthanasia, and reason
2 the greyhound was euthanized rather than adopted.
3 6. If the greyhound was sold or donated, the name of
4 the person to whom the greyhound was sold or donated, and if
5 donated, the name, business address, telephone number, and
6 driver's license number and state of issuance of the person
7 who received the greyhound on behalf of the donee.
8 7. If the disposition of the greyhound does not fit
9 into any of the above categories, the name of the person to
10 whom the greyhound was transferred, and the name, business
11 address, telephone number, and driver's license number and
12 state of issuance of the person who received the greyhound.
13 8. Certification by the owner, trainer, and kennel
14 operator that the disposition forms are correct.
15 (g) The division shall maintain injury and disposition
16 records for 7 years.
17 (h) In addition to other penalties imposed by law, a
18 person who knowingly makes a false statement on an injury or
19 disposition form commits a misdemeanor of the first degree,
20 punishable as provided in s. 775.082 or s. 775.083. A person
21 who knowingly makes a false statement on an injury or
22 disposition form on a second or subsequent occasion commits a
23 felony of the third degree, punishable as provided in s.
24 775.082, s. 775.083, or s. 775.084.
25 Section 2. This act shall take effect July 1, 2004.
