11 Be It Enacted by the Legislature of the State of Florida:
12
13 Section 1. Paragraph (a) of subsection (6) of section
14 1002.20, Florida Statutes, is amended to read:
15 1002.20 K-12 student and parent rights.--Parents of
16 public school students must receive accurate and timely
17 information regarding their child's academic progress and must
18 be informed of ways they can help their child to succeed in
19 school. K-12 students and their parents are afforded numerous
20 statutory rights including, but not limited to, the following:
21 (6) EDUCATIONAL CHOICE.--
22 (a) Public school choices.--Parents of public school
23 students may seek whatever public school choice options that
24 are applicable to their students and are available to students
25 in their school districts. These options may include
26 controlled open enrollment, lab schools, charter schools,
27 charter technical career centers, magnet schools, alternative
28 schools, special programs, advanced placement, dual
29 enrollment, International Baccalaureate, International General
30 Certificate of Secondary Education (pre-AICE), Advanced
31 International Certificate of Education, early admissions,

1 credit by examination or demonstration of competency, the New
2 World School of the Arts, the Florida School for the Deaf and
3 the Blind, and the Florida Virtual School. These options may
4 also include the public school choice options of the
5 Opportunity Scholarship Program and the McKay Scholarships for
6 Students with Disabilities Program.
7 Section 2. Paragraph (d) of subsection (2) of section
8 1002.23, Florida Statutes, is amended to read:
9 1002.23 Family and School Partnership for Student
10 Achievement Act.--
11 (2) To facilitate meaningful parent and family
12 involvement, the Department of Education shall develop
13 guidelines for a parent guide to successful student
14 achievement which describes what parents need to know about
15 their child's educational progress and how they can help their
16 child to succeed in school. The guidelines shall include, but
17 need not be limited to:
18 (d) Opportunities for parents to learn about rigorous
19 academic programs that may be available for their child, such
20 as honors programs, dual enrollment, advanced placement,
21 International Baccalaureate, International General Certificate
22 of Secondary Education (pre-AICE), Advanced International
23 Certificate of Education, Florida Virtual High School courses,
24 and accelerated access to postsecondary education;
25 Section 3. Subsection (2) of section 1007.22, Florida
26 Statutes, is amended to read:
27 1007.22 Articulation; postsecondary institution
28 coordination and collaboration.--
29 (2) The levels of postsecondary education shall
30 collaborate in further developing and providing articulated
31 programs in which students can proceed toward their

1 educational objectives as rapidly as their circumstances
2 permit. Time-shortened educational programs, as well as the
3 use of acceleration mechanisms, shall include, but not be
4 limited to, the International Baccalaureate, Advanced
5 International Certificate of Education, credit by examination
6 or demonstration of competency, advanced placement, early
7 admissions, and dual enrollment.
8 Section 4. Subsection (10) of section 1007.261,
9 Florida Statutes, is amended to read:
10 1007.261 State universities; admissions of
11 students.--Each university board of trustees is authorized to
12 adopt rules governing the admission of students, subject to
13 this section and rules of the State Board of Education.
14 (10) A Florida resident who is denied admission as an
15 undergraduate to a state university for failure to meet the
16 high school grade point average requirement may appeal the
17 decision to the university and request a recalculation of the
18 grade point average including in the revised calculation the
19 grades earned in up to three credits of advanced fine arts
20 courses. The university shall provide the student with a
21 description of the appeals process at the same time as
22 notification of the admissions decision. The university shall
23 recalculate the student's grade point average using the
24 additional courses and advise the student of any changes in
25 the student's admission status. For purposes of this section,
26 fine arts courses include courses in music, drama, painting,
27 sculpture, speech, debate, or a course in any art form that
28 requires manual dexterity. Advanced level fine arts courses
29 include fine arts courses identified in the course code
30 directory as Advanced Placement, pre-International
31 Baccalaureate, or International Baccalaureate, International

1 General Certificate of Secondary Education (pre-AICE), or
2 Advanced International Certificate of Education, or fine arts
3 courses taken in the third or fourth year of a fine arts
4 curriculum.
5 Section 5. Subsection (9) of section 1007.27, Florida
6 Statutes, is amended to read:
7 1007.27 Articulated acceleration mechanisms.--
8 (9) The Advanced International Certificate of
9 Education Program and the International General Certificate of
10 Secondary Education (pre-AICE) Program shall be the curricula
11 curriculum in which eligible secondary students are enrolled
12 in programs of study a program of studies offered through the
13 Advanced International Certificate of Education Program or the
14 International General Certificate of Secondary Education
15 (pre-AICE) Program administered by the University of Cambridge
16 Local Examinations Syndicate. The State Board of Education
17 shall establish rules which specify the cutoff scores and
18 Advanced International Certificate of Education examinations
19 which will be used to grant postsecondary credit at community
20 colleges and universities. Any such rules, which have the
21 effect of raising the required cutoff score or of changing the
22 Advanced International Certification of Education examinations
23 which will be used to grant postsecondary credit, shall apply
24 to students taking Advanced International Certificate of
25 Education examinations after such rules are adopted by the
26 State Board of Education. Students shall be awarded a maximum
27 of 30 semester credit hours pursuant to this subsection. The
28 specific course for which a student receives such credit shall
29 be determined by the community college or university that
30 accepts the student for admission. Students enrolled in either
31 program of study pursuant to this subsection shall be exempt

1 from the payment of any fees for administration of the
2 examinations regardless of whether or not the student achieves
3 a passing score on the examination.
4 Section 6. Paragraph (a) of subsection (3) of section
5 1009.531, Florida Statutes, is amended to read:
6 1009.531 Florida Bright Futures Scholarship Program;
7 student eligibility requirements for initial awards.--
8 (3) For purposes of calculating the grade point
9 average to be used in determining initial eligibility for a
10 Florida Bright Futures Scholarship, the department shall
11 assign additional weights to grades earned in the following
12 courses:
13 (a) Courses identified in the course code directory as
14 Advanced Placement, pre-International Baccalaureate, or
15 International Baccalaureate, International General Certificate
16 of Secondary Education (pre-AICE), or Advanced International
17 Certificate of Education.

19 The department may assign additional weights to courses, other
20 than those described in paragraphs (a) and (b), that are
21 identified by the Department of Education as containing
22 rigorous academic curriculum and performance standards. The
23 additional weight assigned to a course pursuant to this
24 subsection shall not exceed 0.5 per course. The weighted
25 system shall be developed and distributed to all high schools
26 in the state prior to January 1, 1998. The department may
27 determine a student's eligibility status during the senior
28 year before graduation and may inform the student of the award
29 at that time.
30 Section 7. Subsection (1) of section 1009.534, Florida
31 Statutes, is amended to read:

1 1009.534 Florida Academic Scholars award.--
2 (1) A student is eligible for a Florida Academic
3 Scholars award if the student meets the general eligibility
4 requirements for the Florida Bright Futures Scholarship
5 Program and the student:
6 (a) Has achieved a 3.5 weighted grade point average as
7 calculated pursuant to s. 1009.531, or its equivalent, in high
8 school courses that are designated by the State Board of
9 Education as college-preparatory academic courses; and has
10 attained at least the score identified by rules of the State
11 Board of Education on the combined verbal and quantitative
12 parts of the Scholastic Aptitude Test, the Scholastic
13 Assessment Test, or the recentered Scholastic Assessment Test
14 of the College Entrance Examination, or an equivalent score on
15 the ACT Assessment Program; or
16 (b) Has attended a home education program according to
17 s. 1002.41 during grades 11 and 12 or has completed the
18 International Baccalaureate curriculum but failed to earn the
19 International Baccalaureate Diploma or has completed the
20 Advanced International Certificate of Education curriculum but
21 failed to earn the Advanced International Certificate of
22 Education Diploma, and has attained at least the score
23 identified by rules of the Department of Education on the
24 combined verbal and quantitative parts of the Scholastic
25 Aptitude Test, the Scholastic Assessment Test, or the
26 recentered Scholastic Assessment Test of the College Entrance
27 Examination, or an equivalent score on the ACT Assessment
28 Program; or
29 (c) Has been awarded an International Baccalaureate
30 Diploma from the International Baccalaureate Office or an
31 Advanced International Certificate of Education Diploma from

1 the University of Cambridge International Examinations Office
2 ; or
3 (d) Has been recognized by the merit or achievement
4 programs of the National Merit Scholarship Corporation as a
5 scholar or finalist; or
6 (e) Has been recognized by the National Hispanic
7 Recognition Program as a scholar recipient.

9 A student must complete a program of community service work,
10 as approved by the district school board or the administrators
11 of a nonpublic school, which shall include a minimum of 75
12 hours of service work and require the student to identify a
13 social problem that interests him or her, develop a plan for
14 his or her personal involvement in addressing the problem,
15 and, through papers or other presentations, evaluate and
16 reflect upon his or her experience.
17 Section 8. Subsection (1) of section 1009.535, Florida
18 Statutes, is amended to read:
19 1009.535 Florida Medallion Scholars award.--
20 (1) A student is eligible for a Florida Medallion
21 Scholars award if the student meets the general eligibility
22 requirements for the Florida Bright Futures Scholarship
23 Program and the student:
24 (a) Has achieved a weighted grade point average of 3.0
25 as calculated pursuant to s. 1009.531, or the equivalent, in
26 high school courses that are designated by the State Board of
27 Education as college-preparatory academic courses; and has
28 attained at least the score identified by rules of the State
29 Board of Education on the combined verbal and quantitative
30 parts of the Scholastic Aptitude Test, the Scholastic
31 Assessment Test, or the recentered Scholastic Assessment Test

1 of the College Entrance Examination, or an equivalent score on
2 the ACT Assessment Program; or
3 (b) Has attended a home education program according to
4 s. 1002.41 during grades 11 and 12 or has completed the
5 International Baccalaureate curriculum but failed to earn the
6 International Baccalaureate Diploma or has completed the
7 Advanced International Certificate of Education curriculum but
8 failed to earn the Advanced International Certificate of
9 Education Diploma, and has attained at least the score
10 identified by rules of the Department of Education on the
11 combined verbal and quantitative parts of the Scholastic
12 Aptitude Test, the Scholastic Assessment Test, or the
13 recentered Scholastic Assessment Test of the College Entrance
14 Examination, or an equivalent score on the ACT Assessment
15 Program; or
16 (c) Has been recognized by the merit or achievement
17 program of the National Merit Scholarship Corporation as a
18 scholar or finalist but has not completed a program of
19 community service as provided in s. 1009.534; or
20 (d) Has been recognized by the National Hispanic
21 Recognition Program as a scholar, but has not completed a
22 program of community service as provided in s. 1009.534.
23 Section 9. Paragraph (m) of subsection (1) of section
24 1011.62, Florida Statutes, is amended, paragraphs (n), (o),
25 (p), (q), and (r) of that subsection are redesignated as
26 paragraphs (o), (p), (q), (r), and (s), respectively, and a
27 new paragraph (n) is added to that subsection, to read:
28 1011.62 Funds for operation of schools.--If the annual
29 allocation from the Florida Education Finance Program to each
30 district for operation of schools is not determined in the
31 annual appropriations act or the substantive bill implementing

1 the annual appropriations act, it shall be determined as
2 follows:
3 (1) COMPUTATION OF THE BASIC AMOUNT TO BE INCLUDED FOR
4 OPERATION.--The following procedure shall be followed in
5 determining the annual allocation to each district for
6 operation:
7 (m) Calculation of additional full-time equivalent
8 membership based on Advanced International Certificate of
9 Education examination scores of students.--A value of 0.24
10 full-time equivalent student membership shall be calculated
11 for each student enrolled in a full-credit Advanced
12 International Certificate of Education course who receives a
13 score of E 2 or higher on a subject examination. A value of
14 0.12 full-time equivalent student membership shall be
15 calculated for each student enrolled in a half-credit Advanced
16 International Certificate of Education course who receives a
17 score of E 1 or higher on a subject examination. A value of
18 0.3 full-time equivalent student membership shall be
19 calculated for each student who receives received an Advanced
20 International Certificate of Education diploma. Such value
21 shall be added to the total full-time equivalent student
22 membership in basic programs for grades 9 through 12 in the
23 subsequent fiscal year. The school district shall distribute
24 to each classroom teacher who provided Advanced International
25 Certificate of Education instruction:
26 1. A bonus in the amount of $50 for each student
27 taught by the Advanced International Certificate of Education
28 teacher in each full-credit Advanced International Certificate
29 of Education course who receives a score of E 2 or higher on
30 the Advanced International Certificate of Education
31 examination. A bonus in the amount of $25 for each student

1 taught by the Advanced International Certificate of Education
2 teacher in each half-credit Advanced International Certificate
3 of Education course who receives a score of E 1 or higher on
4 the Advanced International Certificate of Education
5 examination.
6 2. An additional bonus of $500 to each Advanced
7 International Certificate of Education teacher in a school
8 designated performance grade category "D" or "F" who has at
9 least one student scoring E 2 or higher on the full-credit
10 Advanced International Certificate of Education examination,
11 regardless of the number of classes taught or of the number of
12 students scoring an E a 2 or higher on the full-credit
13 Advanced International Certificate of Education examination.
14 3. Additional bonuses of $250 each to teachers of
15 half-credit Advanced International Certificate of Education
16 classes in a school designated performance grade category "D"
17 or " F" which has at least one student scoring an E a 1 or
18 higher on the half-credit Advanced International Certificate
19 of Education examination in that class. The maximum additional
20 bonus for a teacher awarded in accordance with this
21 subparagraph shall not exceed $500 in any given school year.
22 Teachers receiving an award under subparagraph 2. are not
23 eligible for a bonus under this subparagraph.

25 Bonuses awarded to a teacher according to this paragraph shall
26 not exceed $2,000 in any given school year and shall be in
27 addition to any regular wage or other bonus the teacher
28 received or is scheduled to receive.
29 (n) Calculation of additional full-time equivalent
30 membership based on International General Certificate of
31 Secondary Education examination scores of students.--A value

1 of 0.12 full-time equivalent student membership shall be
2 calculated for each student enrolled in an International
3 General Certificate of Secondary Education (pre-AICE) course
4 who receives a score of E or higher on a subject examination.
5 A value of 0.15 full-time equivalent student membership shall
6 be calculated for each student who receives an International
7 Certificate of Education diploma. Such value shall be added to
8 the total full-time equivalent student membership in basic
9 programs for grades 9 through 12 in the subsequent fiscal
10 year.
11 Section 10. For the purpose of incorporating the
12 amendment to section 1011.62, Florida Statutes, in a reference
13 thereto, subsection (2) of section 1011.69, Florida Statutes,
14 is reenacted to read:
15 1011.69 Equity in School-Level Funding Act.--
16 (2) Beginning in the 2003-2004 fiscal year, district
17 school boards shall allocate to schools within the district an
18 average of 90 percent of the funds generated by all schools
19 and guarantee that each school receives at least 80 percent of
20 the funds generated by that school based upon the Florida
21 Education Finance Program as provided in s. 1011.62 and the
22 General Appropriations Act, including gross state and local
23 funds, discretionary lottery funds, and funds from the school
24 district's current operating discretionary millage levy. Total
25 funding for each school shall be recalculated during the year
26 to reflect the revised calculations under the Florida
27 Education Finance Program by the state and the actual weighted
28 full-time equivalent students reported by the school during
29 the full-time equivalent student survey periods designated by
30 the Commissioner of Education. If the district school board is
31 providing programs or services to students funded by federal

1 funds, any eligible students enrolled in the schools in the
2 district shall be provided federal funds. Only academic
3 performance-based charter school districts, pursuant to s.
4 1003.62, are exempt from the provisions of this section.
5 Section 11. This act shall take effect July 1, 2004.
