  1                      A bill to be entitled

  2         An act relating to the Conservation and

  3         Recreation Lands Trust Fund; amending s.

  4         259.032, F.S.; authorizing payments in lieu of

  5         taxes from the trust fund to counties where

  6         there are certain categories of state-owned

  7         lands; providing conditions to making such

  8         payments; setting the initial amount of such

  9         payments at a percentage of lost taxes;

10         providing for annual increases in, and setting

11         a maximum on, the amount of the payments;

12         providing an effective date.

14  Be It Enacted by the Legislature of the State of Florida:

15  

16         Section 1.  Paragraph (b) of subsection (12) of section

17  259.032, Florida Statutes, is amended to read:

18         259.032  Conservation and Recreation Lands Trust Fund;

19  purpose.--

21         (b)  Payment in lieu of taxes shall be available:

22         1.  To all counties that have a population of 150,000

23  or fewer. Population levels shall be determined pursuant to s.

24  11.031.

25         2.  To all local governments located in eligible

26  counties.

27         3.  To Glades County, where a privately owned and

28  operated prison leased to the state has recently been opened

29  and where privately owned and operated juvenile justice

30  facilities leased to the state have recently been constructed

31  and opened, a payment in lieu of taxes, in an amount that

 1  offsets the loss of property tax revenue, which funds have

 2  already been appropriated and allocated from the Department of

 3  Correction's budget for the purpose of reimbursing amounts

 4  equal to lost ad valorem taxes.

 5         4.  To all counties where there are state-owned lands,

 6  a payment in lieu of taxes, in an amount that offsets the loss

 7  of property tax, is authorized. Contingent upon legislative

 8  appropriation and the availability of funds, payments shall

 9  begin at the rate of 1 percent of the taxes that would

10  ordinarily be due on the assessed value of improved state

11  property other than military property, forests, parks,

12  recreational areas, college or university property, and

13  hospital property and shall increase each year by 1 percent of

14  such taxes but may not exceed 5 percent of such taxes.

15  

16  For the purposes of this subsection, "local government"

17  includes municipalities, the county school board, mosquito

18  control districts, and any other local government entity which

19  levies ad valorem taxes, with the exception of a water

20  management district.

21         Section 2.  This act shall take effect January 1, 2005.

24                          SENATE SUMMARY

25    Contingent upon legislative appropriation and
      availability of funds, authorizes payments in lieu of
26    taxes from the Conservation and Recreation Lands Trust
      Fund to counties where there are certain categories of
27    state-owned lands. Sets the initial amount of such
      payments at 1 percent of the lost taxes. Provides for
28    annual increases in the amount and places a cap on the
      amount of such payments.
