1 A bill to be entitled
2 An act relating to the use of state funds
3 allocated for purchasing instructional
4 materials; amending s. 1006.40, F.S.; allowing
5 school boards to apply to the Commissioner of
6 Education for authority to use such funds to
7 purchase digital and on-line textbooks and
8 accompanying hardware; providing an effective
9 date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Subsection (4) of section 1006.40, Florida
14 Statutes, is amended to read:
15 1006.40 Use of instructional materials allocation;
16 instructional materials, library books, and reference books;
17 repair of books.--
18 (4) The funds described in subsection (3) which
19 district school boards may use to purchase materials not on
20 the state-adopted list shall be used for the purchase of
21 instructional materials or other items having intellectual
22 content which assist in the instruction of a subject or
23 course. These items may be available in bound, unbound, kit,
24 or package form and may consist of hardbacked or softbacked
25 textbooks, replacements for items which were part of
26 previously purchased instructional materials, consumables,
27 learning laboratories, manipulatives, electronic media,
28 computer courseware or software, and other commonly accepted
29 instructional tools as prescribed by district school board
30 rule. The funds available to district school boards for the
31 purchase of materials not on the state-adopted list may not be

1 used to purchase electronic or computer hardware, except that
2 a school board may apply to the Commissioner of Education for
3 authority to use a portion of these funds for digital and
4 on-line textbooks and for the electronic or computer hardware
5 necessary to provide students with access to such textbooks.
6 These funds may not even if such hardware is bundled with
7 software or other electronic media, nor may such funds be used
8 to purchase other equipment or supplies. However, when
9 authorized to do so in the General Appropriations Act, a
10 school or district school board may use a portion of the funds
11 available to it for the purchase of materials not on the
12 state-adopted list to purchase science laboratory materials
13 and supplies.
14 Section 2. This act shall take effect July 1, 2004.
