11 Senator Constantine moved the following amendment:

13 Senate Amendment (with title amendment)
14 On page 3, lines 21 and 22, delete those lines
15
16 and insert:
17 Section 3. (1) Notwithstanding any other law,
18 instructional personnel, as defined in section 1012.01(2),
19 Florida Statutes, employed by a developmental research school
20 or the Florida School for the Deaf and the Blind are eligible
21 for reemployment after retirement in the same manner as
22 classroom teachers who are employed by the district school
23 boards, as described in sections 121.091(9)(b)3. and
24 238.181(2)(c), Florida Statutes.
25 (2) Instructional personnel, as defined in section
26 1012.01(2), Florida Statutes, employed by a developmental
27 research school and authorized by the school's director, or if
28 the school has no director, by the school's principal, are
29 eligible for the Deferred Retirement Option Program (DROP)
30 beyond 60 months in the same manner as the instructional
31 personnel who are employed by the district school boards and

1 authorized by the district school superintendent, as described
2 in section 121.091(13), Florida Statutes.
3 Section 4. Effective July 1, 2004, the director or
4 principal of a charter school participating in the Florida
5 Retirement System may reemploy a retired member as a
6 substitute or hourly teacher on a noncontractual basis, or
7 reemploy such retired member as instructional personnel, as
8 defined in section 1012.01(2)(a), Florida Statutes, on an
9 annual contractual basis, after he or she has been retired for
10 1 calendar month in accordance with section 121.021(39),
11 Florida Statutes.
12 Section 5. This act shall take effect upon becoming a
13 law and sections 1 and 2 of this act shall apply retroactively
14 to July 1, 2003.

19 On page 1, line 10, after the semicolon,

21 insert:
22 providing that certain reemployment and
23 retirement benefits are available to
24 instructional personnel employed by
25 developmental research schools and the Florida
26 School for the Deaf and the Blind; authorizing
27 the director or principal of certain charter
28 schools to reemploy certain retired teachers
29 under certain circumstances;
