  1                      A bill to be entitled

  2         An act relating to fraud involving leased

  3         property; repealing s. 812.155(7), F.S.;

  4         deleting a provision specifying that certain

  5         penalties imposed for fraudulently obtaining

  6         property or equipment do not apply to a

  7         rental-purchase agreement unless the rental

  8         store retains title to the property or

  9         equipment throughout the period of the

10         rental-purchase agreement; providing an

11         effective date.

13  Be It Enacted by the Legislature of the State of Florida:

14  

15         Section 1.  Subsection (7) of section 812.155, Florida

16  Statutes, is repealed.

17         Section 2.  This act shall take effect July 1, 2004.

20                          SENATE SUMMARY

21    Removes a requirement that in order for certain penalties
      imposed for fraudulently obtaining property or equipment
22    to apply to a rental-purchase agreement, the rental store
      must retain title to the property or equipment throughout
23    the period of the rental-purchase agreement.
