1 A bill to be entitled
2 An act relating to nursing homes and assisted
3 living facilities; creating ss. 400.1425 and
4 400.4425, F.S.; encouraging each nursing home
5 facility and each assisted living facility to
6 have a functioning automated external
7 defibrillator; requiring training, maintenance,
8 and location registration; providing immunity
9 from liability under the Good Samaritan Act and
10 the Cardiac Arrest Survival Act; authorizing
11 the Department of Children and Family Services
12 to adopt rules; requiring the department to
13 arrange for the purchase of the defibrillators;
14 requiring certain entities to reimburse the
15 department for purchased defibrillators under
16 certain circumstances; providing criteria for
17 distribution of the defibrillators; providing
18 an appropriation; providing effective an date.

20 Be It Enacted by the Legislature of the State of Florida:
21
22 Section 1. Section 400.1425, Florida Statutes, is
23 created to read:
24 400.1425 Functioning automated external
25 defibrillator.--
26 (1)(a) Effective July 1, 2005, each nursing home
27 facility is encouraged to have on the premises at all times a
28 functioning automated external defibrillator.
29 (b) A nursing home facility that provides automated
30 external defibrillators shall ensure that personnel are
31 properly trained in accordance with s. 401.2915.

1 (c) The location of each automated defibrillator shall
2 be registered with the appropriate county office by the
3 nursing home facility under s. 401.2915.
4 (d) The use of automated external defibrillators by
5 employees and volunteers shall be covered under the provisions
6 of ss. 768.13 and 768.1325.
7 (2) The department may adopt rules to administer this
8 section.
9 Section 2. Section 400.4425, Florida Statutes, is
10 created to read:
11 400.4425 Functioning automated external
12 defibrillator.--
13 (1)(a) Effective July 1, 2005, each assisted living
14 facility is encouraged to have on the premises at all times a
15 functioning automated external defibrillator.
16 (b) An assisted living facility that provides
17 automated external defibrillators shall ensure that personnel
18 are properly trained in accordance with s. 401.2915.
19 (c) The location of each automated defibrillator shall
20 be registered with the appropriate county office by the
21 assisted living facility under s. 401.2915.
22 (d) The use of automated external defibrillators by
23 employees and volunteers shall be covered under the provisions
24 of ss. 768.13 and 768.1325.
25 (2) The department may adopt rules to administer this
26 section.
27 Section 3. The sum of $270,000 is appropriated to the
28 Department of Children and Family Services for the purpose of
29 implementing this act. The department shall arrange for the
30 purchase of as many automated external defibrillators as may
31 be purchased with available funds. Nursing home facilities and

1 assisted living facilities shall reimburse the department for
2 50 percent of the cost of the automated external defibrillator
3 provided to their facility. The nursing home facilities and
4 assisted living facilities located in rural communities, as
5 defined in sections 288.0656(2)(b) and 288.06561, Florida
6 Statutes, may not be required to reimburse the department for
7 the costs of the equipment. The department shall authorize
8 issuance of the equipment to nursing home facilities and
9 assisted living facilities in the order in which they request
10 one and shall provide authorization for only one to each
11 nursing home facility or assisted living facility under this
12 section.
13 Section 4. This act shall take effect upon becoming a
14 law.

17 SENATE SUMMARY
18 Encourages each nursing home facility and each assisted
living facility to have a functioning automated external
19 defibrillator. Requires training, maintenance, and
location registration. Provides immunity from liability
20 under the Good Samaritan Act and the Cardiac Arrest
Survival Act. Requires the Department of Children and
21 Family Services to arrange for the purchase of the
defibrillators. Requires certain entities to reimburse
22 the department for purchased defibrillators under certain
circumstances. Provides criteria for distribution of the
23 defibrillators.
