1 A bill to be entitled
2 An act relating to government productivity
3 improvement and accountability; creating s.
4 216.1675, F.S.; providing a popular name;
5 providing legislative findings and purpose;
6 designating the Executive Office of the
7 Governor as the agency responsible for
8 directing the productivity improvement and
9 accountability process; requiring the
10 Governor's recommended budget to include
11 certain cost-saving recommendations; requiring
12 submission of such recommendations in
13 legislation, to include an estimate of the
14 productivity improvements and cost savings;
15 providing responsibility for implementation;
16 requiring inclusion of the cost-saving items in
17 the General Appropriations Act; restricting use
18 of the funds from such cost savings; requiring
19 certain quarterly reports; requiring certain
20 cooperation and assistance; providing an
21 effective date.

23 WHEREAS, the State of Florida should follow the wishes
24 of the taxpayers of the state to improve productivity and cost
25 savings in the production and delivery of public goods and
26 services, and
27 WHEREAS, there are standard methods and practices that
28 can be employed by state government to measure, evaluate, and
29 determine productivity and cost savings in the production and
30 delivery of public goods and services, NOW, THEREFORE,

1 Be It Enacted by the Legislature of the State of Florida:

3 Section 1. Section 216.1675, Florida Statutes, is
4 created to read:
5 216.1675 Productivity improvement and
6 accountability.--
7 (1) This section may be cited by the popular name the
8 "Florida Productivity Improvement and Accountability Act."
9 (2) The Legislature finds that there is a need to
10 establish a productivity improvement and accountability
11 process that is fully integrated with the state budgeting
12 process, the purpose of which is to provide a vehicle for
13 reviewing and implementing ideas that improve productivity and
14 reduce the costs of state government services through the
15 state budgeting and appropriations processes.
16 (3) In order to carry out this section, the Executive
17 Office of the Governor is designated as the agency responsible
18 for the coordination, development, direction, monitoring, and
19 evaluation of the productivity improvement and accountability
20 process.
21 (4) As a part of the Governor's recommended budget,
22 the Governor must include recommendations that can generate
23 cost savings and productivity improvements without reducing
24 state government services. These must include estimated
25 timeframes for implementing the recommendations and
26 preliminary estimates of the dollar amount of cost savings
27 expected to be realized. These ideas may originate from any
28 source or productivity and accountability review forum such as
29 the Office of Program Policy Analysis and Government
30 Accountability, Florida TaxWatch, the Auditor General, the
31 Executive Office of the Governor, legislative committees,

1 executive branch agencies, and private citizens. The total
2 amount of the annualized estimates of these specific
3 cost-saving recommendations must equal a minimum of 1 percent
4 of the estimate of net general revenue for the following
5 budget year.
6 (5) These recommendations must be submitted as a bill
7 for consideration by the Legislature. The agency responsible
8 for the service delivery referenced in each recommendation
9 shall be responsible for implementation. The bill must include
10 an estimate of the dollar amounts of the productivity
11 improvements and cost savings, as determined by the applicable
12 consensus estimating conference.
13 (6) The productivity improvement and cost-saving items
14 must be placed in the General Appropriations Act, subject to
15 passage of the bill containing the recommendation.
16 (7) The funds from these specifically identified
17 productivity improvement and cost-saving recommendations shall
18 be placed in reserve and may be used to reduce any budget
19 deficit in recurring general revenue or applied toward the
20 reduction of state debt.
21 (8) State agencies must report quarterly to the
22 Governor in a public hearing on their implementation of the
23 productivity enhancements. The Governor shall report quarterly
24 to the Legislative Budget Commission in a public hearing on
25 the progress achieved in implementing the cost savings and
26 revenue enhancements identified pursuant to this section and
27 shall identify the amounts put in reserve or applied to reduce
28 state debt.
29 (9) All state agencies and the judicial branch are
30 directed to extend maximum cooperation and assistance in the
31 furtherance of this program.

1 Section 2. This act shall take effect upon becoming a
2 law.
