  1                      A bill to be entitled

  2         An act relating to the Lee County Trauma

  3         Services District, an independent district;

  4         amending s. 3 of chapter 2003-357, Laws of

  5         Florida; authorizing the Board of Directors of

  6         the Lee County Trauma Services District to seek

  7         passage of a voter-approved trauma center sales

  8         surtax; providing the amount of the surtax;

  9         providing for the repeal or readoption of the

10         surtax; providing an effective date.

12  Be It Enacted by the Legislature of the State of Florida:

13  

14         Section 1.  The Legislature recognizes that providing

15  timely trauma services is vitally important to the medical

16  outcome for the residents of Lee County who suffer a trauma

17  injury. Therefore, it is the intent of the Legislature that

18  the Lee County Trauma Services District board be authorized to

19  give the residents of Lee County the opportunity to decide

20  whether to fund this critical community service through the

21  levying of a sales surtax.

22         Section 2.  Paragraph (d) of subsection (2) of section

23  3. of chapter 2003-357, Laws of Florida, is amended to read:

25                         CHAPTER 2003-357

26         Section 3.  Powers, functions, and duties.--

27         (2)  The District is hereby authorized to operate and

28  conduct the business of the District and, consistent

29  therewith, shall have the following powers:

30         (d)  To provide for the financial support for the

31  District, the board is authorized to accept gifts, bequests,

 1  grants, endowments, and conveyances from any source for the

 2  use and benefit of the Lee County Trauma Services District. In

 3  addition, the District board may levy a trauma center sales

 4  surtax not to exceed one-sixth cent per dollar to provide

 5  trauma services in the district. This surtax shall take effect

 6  only upon the approval of a majority vote of the electors of

 7  Lee County voting in a referendum on a date to be set by the

 8  District board, and consistent with general law.

 9         Section 3.  The method of levying, collecting, and

10  distributing a surtax approved under this act shall be done

11  according to general law.

12         Section 4.  The surtax is repealed on the last day of

13  the calendar year 5 years after the election provided for in

14  this act, or upon the closure of the trauma center, unless the

15  surtax is readopted by a majority of the electors of Lee

16  County voting in an election held before the date of repeal.

17         Section 5.  This act shall take effect upon becoming a

18  law.
