1 A bill to be entitled
2 An act relating to Hillsborough County;
3 providing definitions; providing purpose;
4 authorizing purchases of goods and services by
5 the county and other public bodies operating in
6 the county under bids submitted to other
7 federal, state, and local governmental
8 entities; providing conditions; providing an
9 exemption; providing construction; providing an
10 effective date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. As used in this act:
15 (1) "Public body" means any entity created by the
16 Florida Constitution, by general or special law, or by
17 ordinance and operating solely within the geographic
18 boundaries of Hillsborough County.
19 (2) "Publicly advertised competitive sealed bidding
20 process" means a process of receiving two or more sealed bids
21 or proposals submitted by responsible vendors who respond to
22 an invitation to bid or request for proposals solicited in a
23 manner compliant with state law. The invitation to bid must
24 include a detailed description of the goods and services
25 sought, the time and date for the receipt of bids and of the
26 public opening, and the contractual terms and conditions
27 applicable to the procurement, including the criteria to be
28 used in determining acceptability of the bid. Solicitations
29 for invitations to bid or requests for proposals include
30 solicitations that are electronically posted as authorized
31 under state law.

1 Section 2. The purpose of this act is to facilitate
2 the purchase of goods and services by a public body by
3 enabling a public body to engage in cooperative purchasing
4 practices with other federal, state, and local governmental
5 entities.
6 Section 3. A public body may purchase goods and
7 services under the terms of a bid submitted to and accepted by
8 any other federal, state, or local governmental entity and
9 under the terms of a contract with such other governmental
10 entity, provided that such bid or contract results from a
11 publicly advertised competitive sealed bidding process.
12 Section 4. Any cooperative purchase made under the
13 provisions of this act is exempt from the requirements for
14 advertising for bids and for competitive sealed bidding
15 otherwise applicable to such purchases, provided that the
16 governmental entity that acts as a purchasing partner to a
17 public body has complied with the requirements of a publicly
18 advertised competitive sealed bidding process.
19 Section 5. This act provides a supplemental,
20 additional, and alternative method of purchasing and is not in
21 derogation of any purchasing powers now existing, including
22 the powers provided for in chapter 69-1119, Laws of Florida.
23 Section 6. This act shall take effect upon becoming a
24 law.
