2 An act relating to Broward County; amending
3 chapter 2001-289, Laws of Florida; authorizing
4 local governments in the county to grant an
5 exemption from impact fees for transportation
6 facilities for certain developments; providing
7 an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Section 1 of chapter 2001-289, Laws of
12 Florida, is amended to read:
13 Section 1. In addition to the exceptions provided in
14 section 163.3180(5)(b), Florida Statutes, a local government
15 in Broward County may grant an exception from the concurrency
16 requirement for transportation facilities pursuant to the
17 provisions of section 163.3180(5)(d), Florida Statutes, if the
18 proposed development is otherwise consistent with the adopted
19 local government comprehensive plan, and is a project that
20 promotes public transportation and is located within a
21 Regional Activity Center as described in and defined by the
22 Broward County Comprehensive Plan, and is within an area that
23 contains major public and private postsecondary institutions
24 of higher learning. The local government also must have
25 considered the proposed development's impacts on the Florida
26 Intrastate Highway System, as defined in section 338.001,
27 Florida Statutes. A local government in Broward County may
28 also grant an exemption from impact fees for transportation
29 facilities if a major public or private postsecondary
30 institution of higher learning has an interest or an option to
31 obtain an interest of more than 25 percent in the proposed

1 development and the proposed development is otherwise
2 consistent with the adopted local government comprehensive
3 plan, is a project that promotes public transportation, is
4 located within a Regional Activity Center as described in and
5 defined by the Broward County Comprehensive Plan, and is
6 within an area that contains major public and private
7 postsecondary institutions of higher learning.
8 Section 2. This act shall take effect upon becoming a
9 law.
