  1                      A bill to be entitled

  2         An act relating to tax sales; creating s.

  3         197.574, F.S.; providing that, when a county

  4         applies for a tax deed for certain property

  5         that is to be sold, the county may impose deed

  6         restrictions that would bring the property into

  7         conformity with the current county

  8         comprehensive plan; providing for notice of the

  9         intent to impose such restrictions; providing

10         for reading the restrictions at public outcry;

11         requiring that the text of the restrictions be

12         placed on a tax deed for the property;

13         providing an effective date.

15  Be It Enacted by the Legislature of the State of Florida:

16  

17         Section 1.  Section 197.574, Florida Statutes, is

18  created to read:

19         197.574  Restrictions imposed at tax sale.--

20         (1)  A county that makes an application for a tax deed

21  pursuant to s. 197.502(3) for property to be sold which is

22  classified for assessment purposes, according to use

23  classifications established by the department, as

24  nonagricultural acreage or vacant land may, at the time of

25  sale, impose upon the title to the property deed restrictions

26  that have the effect of bringing the property into conformity

27  with the current approved comprehensive plan of the county.

28         (2)  A county that elects to impose restrictions under

29  subsection (1) must provide notice of its intent by including

30  the text of the restrictions in the notice provided under s.

31  197.512.

 1         (3)  During the sale at public auction of property with

 2  restrictions imposed under subsection (1) and before the

 3  auction of any particular restricted property, the clerk of

 4  the circuit court of the county where the property is located,

 5  or his or her deputy, shall announce and read the restrictions

 6  at public outcry. Upon sale of the property, the clerk shall

 7  place the text of the restrictions upon the face of any tax

 8  deed for the property issued under s. 197.552.

 9         Section 2.  This act shall take effect July 1, 2004.

12                          SENATE SUMMARY

13    Provides that, when a county applies for a tax deed for
      certain property that is to be sold, the county may
14    impose deed restrictions that would bring the property
      into conformity with the current county comprehensive
15    plan. Provides for notice of the intent to impose such
