10 | Section 3. Subsection (3) of section 119.0721, Florida |
11 | Statutes, is hereby repealed. |
12 | Section 4. The Legislature finds that it is a public |
13 | necessity that social security numbers held by an agency be made |
14 | confidential and exempt from public disclosure. The Legislature |
15 | also finds that it is no longer a necessity to allow commercial |
16 | entity access to such confidential and exempt numbers. |
17 | Commercial entities have cited a number of reasons for needing |
18 | access to social security numbers held by government agencies. |
19 | The prevailing needs are for commercial entity verification of |
20 | the accuracy of personal information received by such entity and |
21 | for commercial entity use in matching, verifying, or retrieving |
22 | information. Alternative methods are available for commercial |
23 | entities to access such confidential and exempt numbers for |
24 | those purposes. Commercial entities may utilize other such |
25 | entities that provide services relating to verification of |
26 | identities and information. Commercial entities should not rely |
27 | upon government for such numbers in order to avoid utilizing the |
28 | services of other such entities. Further, social security |
29 | numbers are of a sensitive personal nature and are often the |
30 | link to an individual's personal, financial, medical, or |
31 | familial records. It is the only nationwide, unique numeric form |
32 | of identification in existence in the United States. Commercial |
33 | entity access to such numbers could lead to misuse of those |
34 | numbers. Such misuse could lead to increased opportunities of |
35 | fraud and identity theft. As such, the Legislature finds that |
36 | the harm from disclosing such numbers to commercial entities |
37 | outweighs any public benefit that can be derived from commercial |
38 | entity access to such numbers. |
39 | Section 5. This act shall take effect upon becoming a law. |
