An act relating to the John M. McKay Scholarships for |

Students with Disabilities Program; amending s. 1002.39, |

F.S.; providing a requirement relating to the employment |

of teachers for private school participation in the |

program; providing an effective date. |

Be It Enacted by the Legislature of the State of Florida: |

|
|

|
Section 1. Paragraph (f) of subsection (4) of section |
11
|
1002.39, Florida Statutes, is amended to read: |

|
1002.39 The John M. McKay Scholarships for Students with |
13
|
Disabilities Program.--There is established a program that is |
14
|
separate and distinct from the Opportunity Scholarship Program |
15
|
and is named the John M. McKay Scholarships for Students with |
16
|
Disabilities Program, pursuant to this section. |

|
(4) PRIVATE SCHOOL ELIGIBILITY.--To be eligible to |
18
|
participate in the John M. McKay Scholarships for Students with |
19
|
Disabilities Program, a private school must be a Florida private |
20
|
school, may be sectarian or nonsectarian, and must: |
21
|
(f)1.Employ or contract with teachers who hold |
22
|
baccalaureate or higher degrees, or have at least 3 years of |
23
|
teaching experience in public or private schools, or have |
24
|
special skills, knowledge, or expertise that qualifies them to |
25
|
provide instruction in subjects taught. |

|
2. Employ at least one teacher who has a bachelor's degree |
27
|
in special education or a master's degree in a related field.

|
Section 2. This act shall take effect July 1, 2004. |
