1 A bill to be entitled
2          An act relating to the John M. McKay Scholarships for
3    Students with Disabilities Program; amending s. 1002.39,
4    F.S.; providing a requirement relating to the employment
5    of teachers for private school participation in the
6    program; providing an effective date.

8          Be It Enacted by the Legislature of the State of Florida:
9         
10          Section 1. Paragraph (f) of subsection (4) of section
11    1002.39, Florida Statutes, is amended to read:
12          1002.39 The John M. McKay Scholarships for Students with
13    Disabilities Program.--There is established a program that is
14    separate and distinct from the Opportunity Scholarship Program
15    and is named the John M. McKay Scholarships for Students with
16    Disabilities Program, pursuant to this section.
17          (4) PRIVATE SCHOOL ELIGIBILITY.--To be eligible to
18    participate in the John M. McKay Scholarships for Students with
19    Disabilities Program, a private school must be a Florida private
20    school, may be sectarian or nonsectarian, and must:
21          (f)1.Employ or contract with teachers who hold
22    baccalaureate or higher degrees, or have at least 3 years of
23    teaching experience in public or private schools, or have
24    special skills, knowledge, or expertise that qualifies them to
25    provide instruction in subjects taught.
26          2. Employ at least one teacher who has a bachelor's degree
27    in special education or a master's degree in a related field.
28          Section 2. This act shall take effect July 1, 2004.
