  1                      A bill to be entitled

  2         An act relating to the Florida Safety Belt law;

  3         amending s. 316.614, Florida Statutes; deleting

  4         a requirement that the safety belt law may only

  5         be enforced as a secondary action against

  6         persons detained for certain other violations;

  7         providing an effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

10  

11         Section 1.  Subsection (8) of section 316.614, Florida

12  Statutes, is amended to read:

13         316.614  Safety belt usage.--

14         (8)  Any person who violates the provisions of this

15  section commits a nonmoving violation, punishable as provided

16  in chapter 318. However, except for violations of s. 316.613,

17  enforcement of this section by state or local law enforcement

18  agencies must be accomplished only as a secondary action when

19  a driver of a motor vehicle has been detained for a suspected

20  violation of another section of this chapter, chapter 320, or

21  chapter 322.

22         Section 2.  This act shall take effect July 1, 2004.

26    Deletes a prohibition against the enforcement of the
      safety belt law except as a secondary action against
