A bill to be entitled
6An act relating to waterway markers; amending s. 327.40,
7F.S.; providing for the placement of certain markers on
8waterways by specified governmental entities; providing an
9exemption with regard to appearance of said markers;
10providing that the placement of specified markers on state
11submerged lands does not subject such lands to certain
12lease requirements; providing an effective date.

14Be It Enacted by the Legislature of the State of Florida:
15
16     Section 1.  Paragraph (c) of subsection (2) of section
17327.40, Florida Statutes, is redesignated as subsection (4), a
18new paragraph (c) is added to subsection (2), and subsection (3)
19of said section is amended, to read:
20     327.40  Uniform waterway markers for safety, and
21navigation, and information.--
22     (2)
23     (c)  The placement of informational markers, including, but
24not limited to, end of boat ramp, no swimming, swimming area,
25lake name, trash receptacle, public health notice, underwater
26hazard, canal, regulatory, emergency, and special event markers
27by counties, municipalities, or other governmental entities in,
28on, or over the waters or shores of landlocked inland lakes and
29their associated canals is exempt from permitting under this
30section. These markers, with the exception of swimming area and
31special event markers, must be placed 50 feet or less from the
32normal shoreline. The appearance of markers placed by counties,
33municipalities, or other governmental entities pursuant to this
34paragraph is not required to conform to the Unites States Aids
35to Navigation System, 33 C.F.R. part 62, or any uniform system
36of waterway markers adopted by the commission. Notwithstanding
37the exemption created by this paragraph, counties,
38municipalities, and other governmental entities shall comply
39with federal laws and regulations when placing informational
40markers on federally regulated waters.
41     (3)  The placement of any safety or navigation marker or
42any marker specified in paragraph (2)(c) on state submerged
43lands under this section does not subject such lands to the
44lease requirements of chapter 253.
45     (4)(c)  The commission is authorized to adopt rules
46pursuant to chapter 120 to implement this section.
47     Section 2.  This act shall take effect upon becoming a law.
