| 1 | A bill to be entitled | 
| 2 | An act relating to waterway markers; amending s. 327.40, | 
| 3 | F.S.; providing for the placement of certain markers on | 
| 4 | waterways by specified governmental entities; providing an | 
| 5 | exemption with regard to appearance of said markers; | 
| 6 | providing that the placement of specified markers on state | 
| 7 | submerged lands does not subject such lands to certain | 
| 8 | lease requirements; providing an effective date. | 
| 9 |

| 10 | Be It Enacted by the Legislature of the State of Florida: | 
| 11 | 
 | 
| 12 | Section 1.  Paragraph (c) of subsection (2) of section | 
| 13 | 327.40, Florida Statutes, is redesignated as subsection (4), a | 
| 14 | new paragraph (c) is added to subsection (2), and subsection (3) | 
| 15 | of said section is amended, to read: | 
| 16 | 327.40  Uniform waterway markers for safety, and | 
| 17 | navigation, and information.-- | 
| 18 | (2) | 
| 19 | (c)  The placement of informational markers, including, but | 
| 20 | not limited to, end of boat ramp, no swimming, swimming area, | 
| 21 | lake name, trash receptacle, public health notice, underwater | 
| 22 | hazard, canal, regulatory, emergency, and special event markers | 
| 23 | by counties, municipalities, or other governmental entities in, | 
| 24 | on, or over the waters or shores of landlocked inland lakes and | 
| 25 | their associated canals is exempt from permitting under this | 
| 26 | section. These markers, with the exception of swimming area and | 
| 27 | special event markers, must be placed 50 feet or less from the | 
| 28 | normal shoreline. The appearance of markers placed by counties, | 
| 29 | municipalities, or other governmental entities pursuant to this | 
| 30 | paragraph is not required to conform to the Unites States Aids | 
| 31 | to Navigation System, 33 C.F.R. part 62, or any uniform system | 
| 32 | of waterway markers adopted by the commission. Notwithstanding | 
| 33 | the exemption created by this paragraph, counties, | 
| 34 | municipalities, and other governmental entities shall comply | 
| 35 | with federal laws and regulations when placing informational | 
| 36 | markers on federally regulated waters. | 
| 37 | (3)  The placement of any safety or navigation marker or | 
| 38 | any marker specified in paragraph (2)(c) on state submerged | 
| 39 | lands under this section does not subject such lands to the | 
| 40 | lease requirements of chapter 253. | 
| 41 | (4) (c)The commission is authorized to adopt rules | 
| 42 | pursuant to chapter 120 to implement this section. | 
| 43 | Section 2.  This act shall take effect upon becoming a law. |
