1 A bill to be entitled
2          An act relating to engineering; amending s. 471.031, F.S.;
3    authorizing certain persons who are exempt from licensure
4    as an engineer to use the title or personnel
5    classification of "engineer" under certain circumstances;
6    providing an effective date.

8          Be It Enacted by the Legislature of the State of Florida:
9         
10          Section 1. Paragraph (b) of subsection (1) of section
11    471.031, Florida Statutes, as amended by section 3 of chapter
12    2003-425, Laws of Florida, is amended to read:
13          471.031 Prohibitions; penalties.--
14          (1) A person may not:
15          (b)1. Except as provided in subparagraph 2. or
16    subparagraph 3., use the name or title "professional engineer"
17    or any other title, designation, words, letters, abbreviations,
18    or device tending to indicate that such person holds an active
19    license as an engineer when the person is not licensed under
20    this chapter, including, but not limited to, the following
21    titles: "agricultural engineer," "air-conditioning engineer,"
22    "architectural engineer," "building engineer," "chemical
23    engineer," "civil engineer," "control systems engineer,"
24    "electrical engineer," "environmental engineer," "fire
25    protection engineer," "industrial engineer," "manufacturing
26    engineer," "mechanical engineer," "metallurgical engineer,"
27    "mining engineer," "minerals engineer," "marine engineer,"
28    "nuclear engineer," "petroleum engineer," "plumbing engineer,"
29    "structural engineer," "transportation engineer," "software
30    engineer," "computer hardware engineer," or "systems engineer."
31          2. Any person who is exempt from licensure under s.
32    471.003(2)(j) may use the title or personnel classification of
33    "engineer" in the scope of his or her work under that exemption
34    if the title does not include or connote the term "professional
35    engineer," "registered engineer," "licensed engineer,"
36    "registered professional engineer," or "licensed professional
37    engineer."
38          3. Any person who is exempt from licensure under s.
39    471.003(2)(c) or (e) may use the title or personnel
40    classification of "engineer" in the scope of his or her work
41    under that exemption if the title does not include or connote
42    the term "professional engineer," "registered engineer,"
43    "licensed engineer," "registered professional engineer," or
44    "licensed professional engineer" and if that person is a
45    graduate from an approved engineering curriculum of 4 years or
46    more in a school, college, or university which has been approved
47    by the board.
48          Section 2. Paragraphs (c) and (e) of subsection (2) of
49    section 471.003, Florida Statutes, read:
50          471.003 Qualifications for practice; exemptions.--
51          (2) The following persons are not required to be licensed
52    under the provisions of this chapter as a licensed engineer:
53          (c) Regular full-time employees of a corporation not
54    engaged in the practice of engineering as such, whose practice
55    of engineering for such corporation is limited to the design or
56    fabrication of manufactured products and servicing of such
57    products.
58          (e) Employees of a firm, corporation, or partnership who
59    are the subordinates of a person in responsible charge, licensed
60    under this chapter.
61          Section 3. This act shall take effect upon becoming a law.
