2 An act relating to public school student
3 progression; amending s. 1008.25, F.S.;
4 requiring that the comprehensive program for
5 student progression include assessment of
6 performance in social studies; amending ss.
7 1003.51 and 1003.52, F.S.; conforming
8 provisions relating to subject area and grade
9 level proficiency of students in education
10 programs of the Department of Juvenile Justice;
11 providing an effective date.

13 Be It Enacted by the Legislature of the State of Florida:
14
15 Section 1. Subsection (1), paragraph (b) of subsection
16 (2), paragraph (a) of subsection (4), and paragraph (a) of
17 subsection (7) of section 1008.25, Florida Statutes, are
18 amended to read:
19 1008.25 Public school student progression; remedial
20 instruction; reporting requirements.--
21 (1) INTENT.--It is the intent of the Legislature that
22 each student's progression from one grade to another be
23 determined, in part, upon proficiency in reading, writing,
24 science, social studies, and mathematics; that district school
25 board policies facilitate such proficiency; and that each
26 student and his or her parent be informed of that student's
27 academic progress.
28 (2) COMPREHENSIVE PROGRAM.--Each district school board
29 shall establish a comprehensive program for student
30 progression which must include:

1 (b) Specific levels of performance in reading,
2 writing, science, social studies, and mathematics for each
3 grade level, including the levels of performance on statewide
4 assessments as defined by the commissioner, below which a
5 student must receive remediation, or be retained within an
6 intensive program that is different from the previous year's
7 program and that takes into account the student's learning
8 style.
9 (4) ASSESSMENT AND REMEDIATION.--
10 (a) Each student must participate in the statewide
11 assessment tests required by s. 1008.22. Each student who does
12 not meet specific levels of performance as determined by the
13 district school board in reading, writing, science, social
14 studies, and mathematics for each grade level, or who does not
15 meet specific levels of performance as determined by the
16 commissioner on statewide assessments at selected grade
17 levels, must be provided with additional diagnostic
18 assessments to determine the nature of the student's
19 difficulty and areas of academic need.
20 (7) ANNUAL REPORT.--
21 (a) In addition to the requirements in paragraph
22 (5)(b), each district school board must annually report to the
23 parent of each student the progress of the student toward
24 achieving state and district expectations for proficiency in
25 reading, writing, science, social studies, and mathematics.
26 The district school board must report to the parent the
27 student's results on each statewide assessment test. The
28 evaluation of each student's progress must be based upon the
29 student's classroom work, observations, tests, district and
30 state assessments, and other relevant information. Progress

1 reporting must be provided to the parent in writing in a
2 format adopted by the district school board.
3 Section 2. Paragraph (c) of subsection (3) of section
4 1003.51, Florida Statutes, is amended to read:
5 1003.51 Other public educational services.--
6 (3) The Department of Education in partnership with
7 the Department of Juvenile Justice, the district school
8 boards, and providers shall:
9 (c) Maintain standardized required content of
10 education records to be included as part of a youth's
11 commitment record. These requirements shall reflect the policy
12 and standards adopted pursuant to subsection (2) and shall
13 include, but not be limited to, the following:
14 1. A copy of the student's individual educational
15 plan.
16 2. Assessment data, including grade level proficiency
17 in reading, writing, science, social studies, and mathematics,
18 and performance on tests taken according to s. 1008.22.
19 3. A copy of the student's permanent cumulative
20 record.
21 4. A copy of the student's academic transcript.
22 5. A portfolio reflecting the youth's academic
23 accomplishments while in the Department of Juvenile Justice
24 program.
25 Section 3. Subsection (7) of section 1003.52, Florida
26 Statutes, is amended to read:
27 1003.52 Educational services in Department of Juvenile
28 Justice programs.--
29 (7) An academic improvement plan shall be developed
30 for students who score below the level specified in district
31 school board policy in reading, writing, science, social

1 studies, and mathematics or below the level specified by the
2 Commissioner of Education on statewide assessments as required
3 by s. 1008.25. These plans shall address academic, literacy,
4 and life skills and shall include provisions for intensive
5 remedial instruction in the areas of weakness.
6 Section 4. This act shall take effect July 1, 2004.

progression in public schools include assessment of

relating to subject area and grade level proficiency of
12 students in Department of Juvenile Justice education
programs.
