  1                      A bill to be entitled

  2         An act relating to health insurance;

  3         prohibiting health insurers from limiting

  4         health insurance coverage to certain counties

  5         in the state; requiring health insurers to make

  6         health insurance coverage available in each

  7         county; prohibiting certain health insurers

  8         from selling or offering for sale health

  9         insurance under certain circumstances;

10         requiring the Office of Insurance Regulation of

11         the Financial Services Commission to monitor

12         health insurers to determine and ensure

13         compliance; requiring the office to enforce

14         compliance; providing an effective date.

16  Be It Enacted by the Legislature of the State of Florida:

18         Section 1.  (1)  Notwithstanding any other provision of

19  law, an insurer that sells or offers for sale in this state

20  policies of health insurance shall not limit such insurance

21  coverage to eligible insureds in specific counties of this

22  state. Each such health insurer shall make such insurance

23  coverage available to eligible insureds in each county of this

24  state. Any health insurer that attempts to limit health

25  insurance coverage to eligible insureds in less than every

26  county in this state shall be prohibited from selling or

27  offering for sale health insurance in this state.

28         (2)  The Office of Insurance Regulation of the

29  Financial Services Commission shall monitor each health

30  insurer that sells or offers for sale health insurance in this

31  state to determine and ensure compliance with the requirements

 1  of this section. The office shall enforce the provisions of

 2  this section if the office determines that a health insurer

 3  fails to comply with the requirements of this section.

 4         Section 2.  This act shall take effect upon becoming a

 5  law.
