| 7 | An act relating to the right to a speedy trial; |
| 8 | authorizing state attorneys to file a demand for a speedy |
| 9 | trial under certain circumstances; requiring that the |
| 10 | trial judge schedule a calendar call upon the filing of a |
| 11 | demand for a speedy trial in order to schedule a trial; |
| 12 | providing an effective date. |

| 14 | Be It Enacted by the Legislature of the State of Florida: |
| 15 |
|
| 16 | Section 1. Victim's right to speedy trial; speedy trial |
| 17 | demand by the state.--After the court grants a third continuance |
| 18 | requested by the defendant in any felony or misdemeanor case, |
| 19 | the state attorney may file a demand for a speedy trial. Upon |
| 20 | filing of the demand, the trial court shall schedule a calendar |
| 21 | call within 5 days, at which time the trial shall be scheduled |
| 22 | for not less than 5 days or more than 45 days following the date |
| 23 | of the calendar call. |
| 24 | Section 2. This act shall take effect July 1, 2004. |
