| 6 | An act relating to the state's entitlement to a speedy |
| 7 | trial; authorizing state attorneys to file a demand for a |
| 8 | speedy trial under certain circumstances; requiring that |
| 9 | the trial judge schedule a calendar call upon the filing |
| 10 | of a demand for a speedy trial in order to schedule a |
| 11 | trial; providing an effective date. |

| 13 | Be It Enacted by the Legislature of the State of Florida: |
| 14 |
|
| 15 | Section 1. State's entitlement to speedy trial; speedy |
| 16 | trial demand by the state.--After the court grants a third |
| 17 | continuance requested by the defendant in any felony or |
| 18 | misdemeanor case, the state attorney may file a demand for a |
| 19 | speedy trial. Upon filing of the demand, the trial court shall |
| 20 | schedule a calendar call within 10 days, at which time the trial |
| 21 | shall be scheduled for not less than 10 days or more than 60 |
| 22 | days following the date of the calendar call, unless good cause |
| 23 | is shown. |
| 24 | Section 2. This act shall take effect July 1, 2004. |
