| 4 | Remove line(s) 28-44 and insert: |
| 5 | (1)(a) It shall be a misdemeanor of the first degree, |
| 6 | punishable as provided in s. 775.082 or s. 775.083, for any |
| 7 | person to willfully harass, threaten, or intimidate an |
| 8 | identifiable member of a neighborhood crime watch program while |
| 9 | such member is engaged in, or traveling to or from, an organized |
| 10 | neighborhood crime watch program activity, for the purpose of |
| 11 | intimidating or retaliating against the member for his or her |
| 12 | participation in a neighborhood crime watch program. |
| 13 | (b) It shall be a misdemeanor of the first degree, |
| 14 | punishable as provided in s. 775.082 or s. 775.083, for a person |
| 15 | to harass a member of a neighborhood crime watch program while |
| 16 | such member is traveling to or from a neighborhood crime watch |
| 17 | meeting, actively participating in a neighborhood crime watch |
| 18 | meeting or activity, or actively participating in an ongoing |
| 19 | criminal investigation, as designated by a law enforcement |
| 20 | officer. |
| 21 | (2) As used in this section, the term: |
| 22 | (a) "Harass" means to engage in a course of conduct |
| 23 | directed at a specific person which causes substantial emotional |
| 24 | distress in that person and serves no legitimate purpose. |
| 25 | (b) "Organized neighborhood crime watch program activity" |
| 26 | means any prearranged event, meeting, or other scheduled |
| 27 | activity, or neighborhood patrol, conducted by or at the |
| 28 | direction of a neighborhood crime watch program or the program's |
| 29 | authorized designee. |
