7 | 373.117, F.S.; providing requirements for certification by |
8 | a professional geologist of water resource activities for |
9 | which a permit or license and such certification are |
10 | required; providing an effective date. |

12 | Be It Enacted by the Legislature of the State of Florida: |

14 | Section 1. Section 373.117, Florida Statutes, is amended |
15 | to read: |
16 | 373.117 Certification by professional engineer or |
17 | professional geologist.-- |
18 | (1) If an application for a permit or license to conduct |
19 | an activity regulated under this chapter requires the services |
20 | of a professional engineer as regulated and defined by chapter |
21 | 471 or a professional geologist as regulated and defined by |
22 | chapter 492, the department or governing board of a water |
23 | management district may require, as a condition of granting a |
24 | permit or license, that a professional engineer licensed under |
25 | chapter 471 or a professional geologist licensed under chapter |
26 | 492 certify upon completion of the permitted or licensed |
27 | activity that such activity has been completed in substantial |
28 | conformance with the plans and specifications approved by the |
29 | department or board. |
30 | (2) The cost of such certification by a professional |
31 | engineer or professional geologist shall be borne by the |
32 | permittee. |
33 | (3) No permitted or licensed activity which is required to |
34 | be so certified shall be placed into use or operation until the |
35 | professional engineer's certificate or the professional |
36 | geologist's signature and seal are is filed with the department |
37 | or board. |
38 | Section 2. This act shall take effect upon becoming a law. |
