11 | clerk of the court to deposit the proceeds of the court |
12 | cost into the State Treasury for deposit into a specified |
13 | trust fund to be used to fund child advocacy centers; |
14 | requiring the clerk of the court to retain a portion of |
15 | the court cost as a service charge; requiring annual |
16 | reports; requiring a report to the Legislature; amending |
17 | s. 39.3035, F.S.; requiring compliance with specified |
18 | provisions in order for a child advocacy center to receive |
19 | certain funding; requiring the Florida Network of |
20 | Children's Advocacy Centers, Inc., to document such |
21 | compliance; providing applicability; providing an |
22 | effective date. |

24 | Be It Enacted by the Legislature of the State of Florida: |

26 | Section 1. Section 938.10, Florida Statutes, is created to |
27 | read: |
28 | 938.10 Additional court cost imposed in cases of certain |
29 | crimes against minors.-- |
30 | (1) If a person pleads guilty or nolo contendere to, or is |
31 | found guilty of, regardless of adjudication, any offense against |
32 | a minor in violation of s. 784.085, chapter 787, chapter 794, s. |
33 | 796.03, s. 800.04, chapter 827, s. 847.0145, or s. 985.4045, the |
34 | court shall impose a court cost of $101 against the offender in |
35 | addition to any other cost or penalty required by law. |
36 | (2) Each month, the clerk of the court shall transfer the |
37 | proceeds of the court cost, less $1 from each sum collected |
38 | which the clerk shall retain as a service charge, to the State |
39 | Treasury for deposit into the Child Advocacy Trust Fund for |
40 | disbursement to the Florida Network of Children's Advocacy |
41 | Centers, Inc., for the purpose of funding child advocacy centers |
42 | that are members of the network. |
43 | (3) At the end of each fiscal year, each child advocacy |
44 | center receiving revenue from the Child Advocacy Trust Fund must |
45 | provide a report to the Board of Directors of the Florida |
46 | Network of Children's Advocacy Centers, Inc., that reflects |
47 | center expenditures, all sources of revenue received, and |
48 | outputs that have been standardized and agreed upon by network |
49 | members and the board of directors, such as the number of |
50 | clients served, client demographic information, and the number |
51 | and types of services provided. The Florida Network of |
52 | Children's Advocacy Centers, Inc., must compile reports from the |
53 | centers and provide a report to the President of the Senate and |
54 | the Speaker of the House of Representatives in August of each |
55 | year beginning in 2005. |
56 | Section 2. Subsection (3) of section 39.3035, Florida |
57 | Statutes, is amended to read: |
58 | 39.3035 Child advocacy centers; standards; state |
59 | funding.-- |
60 | (3) A child advocacy center within this state may not |
61 | receive the funds generated pursuant to s. 938.10, state or |
62 | federal funds administered by a state agency, or any other funds |
63 | appropriated by the Legislature unless all of the standards of |
64 | subsection (1) are met and the screening requirement of |
65 | subsection (2) is met. The Florida Network of Children's |
66 | Advocacy Centers, Inc., shall be responsible for tracking and |
67 | documenting compliance with subsections (1) and (2) for any of |
68 | the above funds it administers to its member child advocacy |
69 | centers Any child advocacy center within this state that meets |
70 | the standards of subsection (1) and is certified by the Florida |
71 | Network of Children's Advocacy Centers, Inc., as being a full |
72 | member in the organization shall be eligible to receive state |
73 | funds that are appropriated by the Legislature. |
74 | Section 3. This act shall take effect July 1, 2004, and |
75 | shall apply to offenses committed on or after that date. |
