11  Senator Bennett moved the following amendment:

13         Senate Amendment (with title amendment) 
14         On page 10, between lines 11 and 12,
15  
16  insert:  (12)  For type "S" buildings, as defined in the
17  Florida Building Code, all space under mezzanines, both
18  enclosed and not enclosed, shall be included in the
19  determination of the size of the room or space in which the
20  mezzanine is located. Mezzanines shall not exceed one-third of
21  the room or space in which they are located. The fee owner or
22  the fee owner's architect may elect, but may not be required
23  by rule or action, to have mezzanines which are less than
24  one-third of the room or space in which they are located. The
25  requirements of this subsection apply retroactively to January
26  1, 2001.
