  1                      A bill to be entitled

  2         An act relating to water resources; creating s.

  3         373.2315, F.S.; providing for restrictions on

  4         the sale or transfer of consumptive use permits

  5         or permitted quantities of groundwater;

  6         providing an effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9  

10         Section 1.  Section 373.2315, Florida Statutes, is

11  created to read:

12         373.2315  Restrictions on the sale or transfer of a

13  consumptive use permit or permitted quantities; exceptions.--

14         (1)  The sale or transfer of a consumptive use permit

15  or a permitted quantity by a permitholder is a new use, and

16  the buyer or transferee must apply for a new consumptive use

17  permit.

18         (2)  The sale of real property which includes a

19  consumptive use permit issued for that property does not

20  constitute a sale or transfer of the permit or a new use under

21  this section.

22         (3)  An interdistrict transfer of groundwater

23  authorized in s. 373.2295 does not constitute a transfer or

24  new use under this section.

25         Section 2.  This act shall take effect upon becoming a

26  law.
