A bill to be entitled
2An act relating to dealing in stolen property; amending s.
3812.022, F.S.; creating an inference that certain persons
4accepting used property knew or should have known that the
5property was stolen if the property conspicuously displays
6specified information; specifying actions such persons may
7take to avoid the inference; providing exceptions
8reenacting s. 812.014(1) and (2), F.S., relating to theft;
9amending s. 921.0022, F.S.; reclassifying the offenses of
10cargo theft of the first degree and cargo theft of the
11second degree under the offense severity ranking chart of
12the Criminal Punishment Code to increase the penalties
13imposed for any such offense; amending s. 812.022, F.S.;
14creating an inference that a dealer in used property knew
15or should have known that he or she possessed stolen
16property if it is proved that the dealer possessed stolen
17property upon which a name and phone number are
18conspicuously displayed; providing that the dealer avoids
19the inference by meeting specified requirements for
20verifying that the property was not stolen; specifying
21records that constitute sufficient evidence to avoid the
22inference; providing exceptions to the application of the
23act; providing an effective date.

25Be It Enacted by the Legislature of the State of Florida:
26
27     Section 1.  Subsection (2) of section 812.022, Florida
28Statutes, is amended, and subsection (5) is added to said
29section, to read:
30     812.022  Evidence of theft or dealing in stolen property.--
31     (2)  Except as provided in subsection (5), proof of
32possession of property recently stolen, unless satisfactorily
33explained, gives rise to an inference that the person in
34possession of the property knew or should have known that the
35property had been stolen.
36     (5)  Proof that a dealer who regularly deals in used
37property possesses stolen property upon which a name and phone
38number of a person other than the offeror of the property are
39conspicuously displayed gives rise to an inference that the
40dealer possessing the property knew or should have known that
41the property was stolen.
42     (a)  If the name and phone number are for a business that
43rents property, the dealer avoids the inference by contacting
44such business, prior to accepting the property, to verify that
45the property was not stolen from such business. If the name and
46phone number are not for a business that rents property, the
47dealer avoids the inference by contacting the local law
48enforcement agency in the jurisdiction where the dealer is
49located, prior to accepting the property, to verify that the
50property has not been reported stolen. An accurate written
51record, which contains the number called, the date and time of
52such call, and the name and place of employment of the person
53who verified that the property was not stolen, is sufficient
54evidence to avoid the inference pursuant to this subsection.
55     (b)  This subsection does not apply to:
56     1.  Persons, entities, or transactions exempt from chapter
57538.
58     2.  Used sports equipment that does not contain a serial
59number, printed or recorded materials, computer software, or
60videos or video games.
61     3.  A dealer who implements, in a continuous and consistent
62manner, a program for identification and return of stolen
63property that meets the following criteria:
64     a.  When a dealer is offered property for pawn or purchase
65that contains conspicuous identifying information that includes
66a name and phone number, or a dealer is offered property for
67pawn or purchase that contains ownership information that is
68affixed to the property pursuant to a written agreement with a
69business entity or group of associated business entities, the
70dealer will promptly contact the individual or company whose
71name is affixed to the property by phone to confirm that the
72property has not been stolen. If the individual or business
73contacted indicates that the property has been stolen, the
74dealer shall not accept the property.
75     b.  If the dealer is unable to verify whether the property
76is stolen from the individual or business, and if the dealer
77accepts the property that is later determined to have been
78stolen,, the dealer will voluntarily return the property at no
79cost and without the necessity of a replevin action, if the
80property owner files the appropriate theft reports with law
81enforcement and enters into an agreement with the dealer to
82actively participate in the prosecution of the person or persons
83who perpetrated the crime.
84     c.  If a dealer is required by law to complete and submit a
85transaction form to law enforcement, the dealer shall include
86all conspicuously displayed ownership information on the
87transaction form.
88     Section 2.  Subsections (1) and (2) of section 812.014,
89Florida Statutes, are reenacted to read:
90     812.014  Theft.--
91     (1)  A person commits theft if he or she knowingly obtains
92or uses, or endeavors to obtain or to use, the property of
93another with intent to, either temporarily or permanently:
94     (a)  Deprive the other person of a right to the property or
95a benefit from the property.
96     (b)  Appropriate the property to his or her own use or to
97the use of any person not entitled to the use of the property.
98     (2)(a)1.  If the property stolen is valued at $100,000 or
99more; or
100     2.  If the property stolen is cargo valued at $50,000 or
101more that has entered the stream of interstate or intrastate
102commerce from the shipper's loading platform to the consignee's
103receiving dock; or
104     3.  If the offender commits any grand theft and:
105     a.  In the course of committing the offense the offender
106uses a motor vehicle as an instrumentality, other than merely as
107a getaway vehicle, to assist in committing the offense and
108thereby damages the real property of another; or
109     b.  In the course of committing the offense the offender
110causes damage to the real or personal property of another in
111excess of $1,000,

113 the offender commits grand theft in the first degree,
114punishable as a felony of the first degree, as provided in s.
115775.082, s. 775.083, or s. 775.084.
116     (b)1.  If the property stolen is valued at $20,000 or more,
117but less than $100,000;
118     2.  The property stolen is cargo valued at less than
119$50,000 that has entered the stream of interstate or intrastate
120commerce from the shipper's loading platform to the consignee's
121receiving dock; or
122     3.  The property stolen is emergency medical equipment,
123valued at $300 or more, that is taken from a facility licensed
124under chapter 395 or from an aircraft or vehicle permitted under
125chapter 401,

127 the offender commits grand theft in the second degree,
128punishable as a felony of the second degree, as provided in s.
129775.082, s. 775.083, or s. 775.084. Emergency medical equipment
130means mechanical or electronic apparatus used to provide
131emergency services and care as defined in s. 395.002(10) or to
132treat medical emergencies.
133     (c)  It is grand theft of the third degree and a felony of
134the third degree, punishable as provided in s. 775.082, s.
135775.083, or s. 775.084, if the property stolen is:
136     1.  Valued at $300 or more, but less than $5,000.
137     2.  Valued at $5,000 or more, but less than $10,000.
138     3.  Valued at $10,000 or more, but less than $20,000.
139     4.  A will, codicil, or other testamentary instrument.
140     5.  A firearm.
141     6.  A motor vehicle, except as provided in paragraph
142(2)(a).
143     7.  Any commercially farmed animal, including any animal of
144the equine, bovine, or swine class, or other grazing animal, and
145including aquaculture species raised at a certified aquaculture
146facility.  If the property stolen is aquaculture species raised
147at a certified aquaculture facility, then a $10,000 fine shall
148be imposed.
149     8.  Any fire extinguisher.
150     9.  Any amount of citrus fruit consisting of 2,000 or more
151individual pieces of fruit.
152     10.  Taken from a designated construction site identified
153by the posting of a sign as provided for in s. 810.09(2)(d).
154     11.  Any stop sign.
155     12.  Anyhydrous ammonia.
156     (d)  It is grand theft of the third degree and a felony of
157the third degree, punishable as provided in s. 775.082, s.
158775.083, or s. 775.084, if the property stolen is valued at $100
159or more, but less than $300, and is taken from a dwelling as
160defined in s. 810.011(2) or from the unenclosed curtilage of a
161dwelling pursuant to s. 810.09(1).
162     (e)  Except as provided in paragraph (d), if the property
163stolen is valued at $100 or more, but less than $300, the
164offender commits petit theft of the first degree, punishable as
165a misdemeanor of the first degree, as provided in s. 775.082 or
166s. 775.083.
167     Section 3.  Paragraphs (f), (g), and (h) of subsection (3)
168of section 921.0022, Florida Statutes, are amended to read:
