1 A bill to be entitled
2          An act relating to the State Apprenticeship Advisory
3    Council; amending s. 446.045, F.S.; deleting a requirement
4    that the Governor appoint two nominating committees for
5    the purpose of filling vacancies on the council; revising
6    provisions relating to member representation of
7    industries; revising provisions relating to terms of
8    appointment; providing an effective date.
9         
10          Be It Enacted by the Legislature of the State of Florida:
11         
12          Section 1. Section 446.045, Florida Statutes, is amended
13    to read:
14          446.045 State Apprenticeship Advisory Council.--
15          (1) For the purposes of this section, the term:
16          (a) "Joint employee organization" means an apprenticeship
17    sponsor who participates in a collective bargaining agreement
18    and represents employees.
19          (b) "Nonjoint employer organization" means an
20    apprenticeship sponsor who does not participate in a collective
21    bargaining agreement and who represents management.
22          (2)(a) There is created a State Apprenticeship Advisory
23    Council to be composed of 13 members appointed by the Governor,
24    which shall be advisory to the Division of Workforce
25    Development. The purpose of the advisory council is to advise
26    the division and the council on matters relating to
27    apprenticeship. The advisory council may not establish policy,
28    adopt rules, or consider whether particular apprenticeship
29    programs should be approved by the division.
30          (b) The division director or the division director's
31    designee shall be ex officio chair of the State Apprenticeship
32    Advisory Council, but may not vote. The state director of the
33    Bureau of Apprenticeship and Training of the United States
34    Department of Labor shall be appointed a nonvoting member of the
35    council. The Governor shall appoint two three-member committees
36    for the purpose of nominating candidates for appointment to the
37    council. One nominating committee shall be composed of joint
38    employee organization representatives, and the other nominating
39    committee shall be composed of nonjoint employer organization
40    representatives. The joint employee organization nominating
41    committee shall submit to the Governor the names of three
42    persons for each vacancy occurring among the joint employee
43    organization members on the council, and the nonjoint employer
44    organization nominating committee likewise shall submit to the
45    Governor the names of three persons for each vacancy occurring
46    among the nonjoint employer organization members on the council.
47    The Governor shall appoint to the council five members
48    representing joint employee organizations and five members
49    representing nonjoint employer organizations from the candidates
50    nominated for each position by the respective nominating
51    committees. Each member shall represent industries that which
52    have registered apprenticeship programs or in which a need for
53    apprenticeship programs has been demonstrated. Initially, the
54    Governor shall appoint four members for terms of 4 years, two
55    members for terms of 3 years, two members for terms of 2 years,
56    and two members for terms of 1 year. Thereafter,Members shall
57    be appointed for 4-year terms. A vacancy shall be filled for the
58    remainder of the unexpired term.
59          (c) The council shall meet at the call of the chair or at
60    the request of a majority of its membership, but at least twice
61    a year. A majority of the voting members shall constitute a
62    quorum, and the affirmative vote of a majority of a quorum is
63    necessary to take action.
64          (d) The Governor may remove any member for cause.
65          (e) The council shall maintain minutes of each meeting.
66    The division shall keep on file the minutes of each meeting and
67    shall make such minutes available to any interested person.
68          (f) Members of the council shall serve without
69    compensation, but shall be entitled to receive reimbursement for
70    per diem and travel expenses as provided in s. 112.061.
71          Section 2. This act shall take effect upon becoming a law.
