1 A bill to be entitled
2 An act relating to display of flags in the
3 public school system; amending s. 1000.06,
4 F.S.; requiring that the flag of the United
5 States be displayed in each classroom;
6 providing for the purchase or donation of such
7 flags; providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Section 1000.06, Florida Statutes, is
12 amended to read:
13 1000.06 Display of flags.--
14 (1) Every public K-20 educational institution that is
15 provided or authorized by the Constitution and laws of Florida
16 shall display daily the flag of the United States and the
17 official flag of Florida when the weather permits upon one
18 building or on a suitable flagstaff upon the grounds of each
19 public postsecondary educational institution and upon every
20 district school board building or grounds except when the
21 institution or school is closed for vacation, provided that,
22 if two or more buildings are located on the same or on
23 adjacent sites, one flag may be displayed for the entire group
24 of buildings.
25 (2) Every public K-20 educational institution and
26 every educational institution providing postgraduate or
27 professional programs which is provided or authorized by the
28 Constitution and laws of this state shall display daily in
29 each classroom the flag of the United States. The flag must be
30 made of cloth, be at least 2 feet by 3 feet, and be properly
31 displayed in a suitable location in the classroom. Every

1 community college, state university, and educational
2 institution that provides postgraduate or professional
3 programs shall purchase, using student activity and service
4 fees, a sufficient number of flags and necessary display
5 hardware to carry out the purpose of this subsection. Labor to
6 install such flags shall be the responsibility of each
7 educational institution and shall be paid for using funds,
8 other than student activity and service fees, from that
9 institution. All other educational institutions shall
10 purchase, using funds from that institution, the necessary
11 number of flags to carry out the purpose of this subsection,
12 after seeking donations of such flags from local veterans'
13 associations. Each institution shall comply with the
14 requirements for this subsection prior to July 1, 2005.
15 Section 2. This act shall take effect July 1, 2004.

COMMITTEE SUBSTITUTE FOR
18 Senate Bill 612

20 The committee substitute clarifies that the flag must be made
of cloth rather than a display of a picture of a flag or some
21 other rendition. Student activity and service fees are to be
used for the purchase of the flags and the necessary display
22 hardware. The actual installation of the flags would be the
responsibility of the educational institution. A time period
23 is added to the bill to mandate that the provisions of the
bill be satisfied prior to July 1, 2005.
