1 A bill to be entitled
2          An act relating to a public records exemption; amending s.
3    119.07, F.S.; providing an exemption from public records
4    requirements for the names, home addresses, telephone
5    numbers, social security numbers, and photographs of
6    children who participate in government-sponsored
7    recreation programs or camps, the names and locations of
8    the schools attended by such children, and the names, home
9    addresses, telephone numbers, and social security numbers
10    of the parents or guardians of such children; providing
11    for future review and repeal of the exemption; providing a
12    statement of public necessity; providing an effective
13    date.

15          Be It Enacted by the Legislature of the State of Florida:

17          Section 1. Paragraph (hh) is added to subsection (3) of
18    section 119.07, Florida Statutes, to read:
19          119.07 Inspection, examination, and duplication of
20    records; exemptions.--
21          (3)
22          (hh) The names, home addresses, telephone numbers, social
23    security numbers, and photographs of children who participate in
24    government-sponsored recreation programs or camps; the names and
25    locations of the schools attended by such children; and the
26    names, home addresses, telephone numbers, and social security
27    numbers of parents or guardians of children who participate in
28    government-sponsored recreation programs or camps are exempt
29    from subsection (1) and s. 24(a), Art. I of the State
30    Constitution.
31          Section 2. Paragraph (hh) of subsection (3) of s. 119.07,
32    Florida Statutes, is subject to the Open Government Sunset
33    Review Act of 1995 in accordance with s. 119.15, Florida
34    Statutes, and shall stand repealed on October 2, 2009, unless
35    reviewed and saved from repeal through reenactment by the
36    Legislature.
37          Section 3. The Legislature finds that it is a public
38    necessity that the names, home addresses, telephone numbers,
39    social security numbers, and photographs of children who
40    participate in government-sponsored recreation programs or
41    camps, the names and locations of the schools attended by such
42    children, and the names, home addresses, telephone numbers, and
43    social security numbers of the parents or guardians of such
44    children be held confidential and exempt from public records
45    requirements because revealing such information could create the
46    opportunity for the stalking, harassment, abduction, or abuse of
47    such children.
48          Section 4. This act shall take effect upon becoming a law.
