  1                      A bill to be entitled

  2         An act relating to fire hydrants; requiring

  3         owners of private fire hydrants to contract

  4         with licensed professionals or local

  5         fire-control authorities to inspect and service

  6         such hydrants; providing an effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9  

10         Section 1.  (1)  A person who owns a private fire

11  hydrant must ensure that the hydrant is installed in

12  compliance with the provisions of National Fire Protection

13  Association Standard 24, Standard for the Installation of

14  Private Fire Service Mains and Their Appurtenances, and that

15  it is inspected and maintained in compliance with the

16  provisions of National Fire Protection Association Standard

17  25, Standard for the Inspection, Testing, and Maintenance of

18  Water-Based Fire Protection Systems, the edition currently

19  adopted by the State Fire Marshal pursuant to its

20  code-adoption and standards-adoption authority in chapter 633,

21  Florida Statutes. A person who owns a private fire hydrant

22  must produce, upon request of the fire official, a valid and

23  continuing maintenance contract with a plumbing contractor

24  licensed under chapter 489, Florida Statutes, an underground

25  utility contractor licensed under chapter 489, Florida

26  Statutes, or, if the private hydrant is part of a fire

27  suppression system, a fire protection contractor licensed

28  under chapter 633, Florida Statutes. Upon failure to produce a

29  valid maintenance contract as provided in this section, the

30  owner must contract with the local government fire-control

 1  authority that serves the property where the fire hydrant is

 2  located to inspect and service the fire hydrant annually.

 3         (2)  A person who violates this section commits a

 4  noncriminal violation, punishable by a fine not to exceed $100

 5  for a first offense or $250 for each subsequent offense.

 6         Section 2.  This act shall take effect July 1, 2004.

 9                          SENATE SUMMARY

10    Requires owners of private fire hydrants to contract with
      licensed professionals or local fire-control authorities
11    to inspect and service such hydrants, to ensure that they
      are installed, maintained, and inspected properly, and to
12    produce, upon request, a valid and continuing maintenance
      contract for the hydrant.
