6An act relating to the Southwest Florida Water Management
7District; amending s. 373.073, F.S.; revising the
8residency requirements for vacancies on, and replacement
9of members of, the governing board of the district;
10providing an effective date.

12Be It Enacted by the Legislature of the State of Florida:
13
14     Section 1.  Paragraph (e) of subsection (2) of section
15373.073, Florida Statutes, is amended to read:
16     373.073  Governing board.--
17     (2)  Membership on governing boards shall be selected from
18candidates who have significant experience in one or more of the
19following areas, including, but not limited to: agriculture, the
20development industry, local government, government-owned or
21privately owned water utilities, law, civil engineering,
22environmental science, hydrology, accounting, or financial
23businesses. Notwithstanding the provisions of any other general
24or special law to the contrary, vacancies in the governing
25boards of the water management districts shall be filled
26according to the following residency requirements, representing
27areas designated by the United States Water Resources Council in
28United States Geological Survey, River Basin and Hydrological
29Unit Map of Florida--1975, Map Series No. 72:
30     (e)  Southwest Florida Water Management District:
31     1.  Two members shall reside in Hillsborough County.
32     2.  One member shall be appointed from any of the counties
33within the geographical area of the Southwest Florida Water
34Management District reside in the area consisting of
35Hillsborough and Pinellas Counties.
36     3.  Two members shall reside in Pinellas County.
37     4.  One member shall reside in Manatee County.
38     5.  One member shall reside in Polk County.
39     6.  One member shall reside in Pasco County.
40     7.  One member shall be appointed at large from Levy,
41Marion, Citrus, Sumter, Hernando, and Lake Counties.
42     8.  One member shall be appointed at large from Sarasota,
43Hardee, DeSoto, Charlotte, and Highlands Counties.
44     9.  One member shall be appointed at large from Levy,
45Marion, Citrus, Sumter, Hernando, Lake, Sarasota, Hardee,
46DeSoto, Charlotte, and Highlands Counties.

48No county described in subparagraph 7., subparagraph 8., or
49subparagraph 9. shall have more than one member on the governing
50board.  The composition of the Southwest Florida Water
51Management District governing board shall be subject to a study
52by the Legislative Committee on Intergovernmental Relations.
53Such review shall analyze and make recommendations concerning
54equitable board composition based on quantifiable measures such
55as an area's water resources, water supply, population,
56geographical area, and ad valorem contribution. Such study shall
57be conducted every 10 years with the initial study to be
58completed and provided to the Speaker of the House of
59Representatives, the President of the Senate, and the Governor
60prior to February 1, 2005. Any member of the governing board of
61the Southwest Florida Water Management District whose term
62expires between May 30, 2004, and May 30, 2005, shall not be
63replaced prior to May 30, 2005.
64     Section 2.  This act shall take effect upon becoming a law.
