11 | requiring training, maintenance, and location |
12 | registration; providing immunity from liability under the |
13 | Good Samaritan Act and the Cardiac Arrest Survival Act; |
14 | authorizing the Department of Eldery Affairs to adopt |
15 | rules; requiring the department to arrange for purchase of |
16 | such defibrillators; requiring certain entities to |
17 | reimburse the department for purchased defibrillators |
18 | under certain circumstances; providing criteria for |
19 | distribution of such defibrillators; providing an |
20 | appropriation; providing effective dates. |

22 | Be It Enacted by the Legislature of the State of Florida: |
23 |
|
24 | Section 1. Subsection (10) of section 430.203, Florida |
25 | Statutes, is amended to read: |
26 | 430.203 Community care for the elderly; definitions.--As |
27 | used in ss. 430.201-430.207, the term: |
28 | (10) "Multiservice senior center" means a community |
29 | facility for the organization and provision of a broad spectrum |
30 | of that serves as the focal point for housing and delivering |
31 | services, which shall include provision of health, including |
32 | mental health, social, nutritional, and education services, and |
33 | the provision of facilities for recreational activities for to |
34 | persons 60 years of age or older. |
35 | Section 2. Subsection (3) is added to section 430.206, |
36 | Florida Statutes, to read: |
37 | 430.206 Multiservice senior center.-- |
38 | (3)(a) Effective July 1, 2004, each multiservice senior |
39 | center is encouraged to have on the premises at all times a |
40 | functioning automated external defibrillator. |
41 | (b) Multiservice senior centers that provide automated |
42 | external defibrillators shall ensure that personnel are properly |
43 | trained in accordance with s. 401.2915. |
44 | (c) The location of each automated external defibrillator |
45 | shall be registered with the appropriate county office by the |
46 | multiservice senior center pursuant to s. 401.2915. |
47 | (d) The use of automated external defibrillators by |
48 | employees and volunteers shall be covered under the provisions |
49 | of ss. 768.13 and 768.1325. |
50 | (e) The department may adopt rules to implement the |
51 | provisions of this section. |
52 | Section 3. The sum of $270,000 is appropriated from the |
53 | General Revenue Fund to the Department of Elderly Affairs for |
54 | the purpose of implementing this act during the 2004-2005 fiscal |
55 | year. The department shall arrange for the purchase of as many |
56 | automated external defibrillators as may be purchased with |
57 | available funds. Senior centers shall reimburse the department |
58 | for 50 percent of the cost of the automated external |
59 | defibrillator provided to their facility. Multiservice senior |
60 | centers located in rural communities, as defined in section |
61 | 288.0656(2)(b), Florida Statutes, shall not be required to |
62 | reimburse the department for the costs of such equipment. The |
63 | department shall authorize issuance of the equipment to senior |
64 | centers in the order in which they request one and shall provide |
65 | authorization for only one to each multiservice center pursuant |
66 | to this section. |
67 | Section 4. Except as otherwise provided herein, this act |
68 | shall take effect upon becoming a law. |
