2 An act relating to publication information;
3 creating s. 283.551, F.S.; prohibiting
4 government agencies from mailing general
5 unsolicited reports to any person in the state;
6 providing exceptions; providing requirements
7 for agency reports; providing an effective
8 date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Section 283.551, Florida Statutes, is
13 created to read:
14 283.551 Unsolicited distribution of general reports by
15 mail prohibited; exceptions.--
16 (1)(a) Unless otherwise authorized by law, an agency
17 may not mail an unsolicited copy of an annual report or
18 periodic newsletter by United States Postal Service, or other
19 method of delivery, except e-mail, to any person, including an
20 elected or appointed officer or governmental employee, except
21 for any state elected or appointed state officer or state
22 legislative employee. This section does not apply to
23 regulatory newsletters provided to affected persons or to
24 reports or newsletters relating to the prevention or treatment
25 of disease or injury.
26 (b) Unsolicited agency e-mails authorized by this
27 section must contain a provision that allows the recipient to
28 be removed from future unsolicited agency e-mails upon his or
29 her e-mail request.
30 (2) An agency shall send to any person, including an
31 elected or appointed officer or governmental employee, or to

1 any state or local governmental entity, a copy of a general
2 report or newsletter by United States Postal Service, by
3 e-mail, or by other method of delivery:
4 (a) Upon a specific request for a particular report or
5 newsletter; or
6 (b) Upon a general request to receive all agency
7 reports or newsletters, which request must be renewed as
8 provided in s. 283.55.
9 (3) A request for a report or newsletter must state
10 whether the recipient wishes to receive the document by
11 regular mail, by e-mail, or by other method of delivery.
12 (4) An agency may post any general report on its
13 Internet website.
14 Section 2. This act shall take effect upon becoming a
15 law.
