1 A bill to be entitled
2          An act relating to state university student fees; amending
3    s. 1009.24, F.S.; providing an exemption from caps for an
4    increase in the athletic fee to defray the costs
5    associated with changing athletic competitive divisions;
6    requiring approval of such increase; providing an
7    effective date.

9          Be It Enacted by the Legislature of the State of Florida:
10         
11          Section 1. Subsection (3) of section 1009.24, Florida
12    Statutes, is amended to read:
13          1009.24 State university student fees.--
14          (3) Within proviso in the General Appropriations Act and
15    law, each board of trustees shall set university tuition and
16    fees. The sum of the activity and service, health, and athletic
17    fees a student is required to pay to register for a course shall
18    not exceed 40 percent of the tuition established in law or in
19    the General Appropriations Act. No university shall be required
20    to lower any fee in effect on the effective date of this act in
21    order to comply with this subsection. Within the 40 percent cap,
22    universities may not increase the aggregate sum of activity and
23    service, health, and athletic fees more than 5 percent per year
24    unless specifically authorized in law or in the General
25    Appropriations Act. A university that changes athletic
26    competitive divisions may increase the athletic fee to defray
27    the costs associated with changing divisions. Any such increase
28    in the athletic fee is exempt from both the 40 percent cap and
29    the 5 percent cap on yearly increases in the sum of the activity
30    and service, health, and athletic fees. Any such increase must
31    be approved by the athletic fee committee in the process
32    outlined in subsection (11) and cannot exceed $2 per credit
33    hour.This subsection does not prohibit a university from
34    increasing or assessing optional fees related to specific
35    activities if payment of such fees is not required as a part of
36    registration for courses.
37          Section 2. This act shall take effect upon becoming a law.
