  2         An act relating to a review under the Open

  3         Government Sunset Review Act; amending s.

  4         400.945, F.S., relating to a public-records

  5         exemption for information concerning patients

  6         of a home medical equipment provider; saving

  7         the exemption from repeal under the Open

  8         Government Sunset Review Act; deleting

  9         provisions that provide for the repeal of the

10         exemption; providing an effective date.

12  Be It Enacted by the Legislature of the State of Florida:

13  

14         Section 1.  Section 400.945, Florida Statutes, is

15  amended to read:

16         400.945  Public records exemption.--Medical and other

17  personal identifying information about patients of a home

18  medical equipment provider which is received by the licensing

19  agency through reports or inspection is confidential and

20  exempt from the provisions of s. 119.07(1) and s. 24(a), Art.

21  I of the State Constitution. This section is subject to the

22  Open Government Sunset Review Act of 1995 in accordance with

23  s. 119.15 and shall stand repealed on October 2, 2004, unless

24  reviewed and saved from repeal through reenactment by the

25  Legislature.

26         Section 2.  This act shall take effect October 1, 2004.
