| 1 | A bill to be entitled | ||
| 2 | An act relating to public K-12 education; amending s. | ||
| 3 | 1003.05, F.S.; allowing children of military personnel | ||

| 5 | enroll in certain schools or programs in the state; | ||
| 6 | providing for priority listing for enrollment under | ||
| 7 | certain circumstances; providing an effective date. | ||

| 9 | Be It Enacted by the Legislature of the State of Florida: | ||
| 10 | |||
| 11 | Section 1. Subsection (2) of section 1003.05, Florida | ||
| 12 | Statutes, is renumbered as subsection (3), and a new subsection | ||
| 13 | (2) is added to said section to read: | ||
| 14 | 1003.05 Assistance to transitioning students from military | ||
| 15 | families.-- | ||
| 16 | (2) Children of military personnel who receive military | ||
| 17 | orders to transfer to Florida after a school year has begun | ||
| 18 | shall be allowed to enroll in a school or program included in | ||
| 19 | the public school choice options, listed in s. 1002.20(6)(a); in | ||
| 20 | a public school that provides exceptional student education; or | ||
| 21 | in a public school exceptional student program if they were | ||
| 22 | enrolled in such a school or program in the state from which | ||
| 23 | transferred. A school's enrollment deadline shall not prevent | ||
| 24 | such student from enrolling in a school or program pursuant to | ||
| 25 | this subsection. However, if such student is unable to enroll in | ||
| 26 | a school or program pursuant to this subsection due to space | ||
| 27 | limitation, such student shall be priority listed for enrollment | ||
| 28 | for the upcoming school term or school year. | ||
| 29 | Section 2. This act shall take effect July 1, 2004. | ||
