8 | transferred to Florida after a school year has begun to |
9 | enroll in certain schools or programs in the state; |
10 | providing that a student shall be enlisted for enrollment |
11 | under certain circumstances; providing an effective date. |

13 | Be It Enacted by the Legislature of the State of Florida: |

15 | Section 1. Subsection (2) of section 1003.05, Florida |
16 | Statutes, is renumbered as subsection (3), and a new subsection |
17 | (2) is added to said section to read: |
18 | 1003.05 Assistance to transitioning students from military |
19 | families.-- |
20 | (2) Children of military personnel who receive military |
21 | orders to transfer to this state after a school year has begun |
22 | shall be allowed to enroll in a school or program included in |
23 | the public school choice options, listed in s. 1002.20(6)(a); in |
24 | a public school that provides exceptional student education; or |
25 | in a public school exceptional student program if they were |
26 | enrolled in such a school or program in the state from which |
27 | they transferred. A school's enrollment deadline shall not |
28 | prevent such student from enrolling in a school or program |
29 | pursuant to this subsection. However, if such student is unable |
30 | to enroll in a school or program pursuant to this subsection due |
31 | to space limitation, such student shall be listed for enrollment |
32 | for the upcoming school term or school year. |
33 | Section 2. This act shall take effect July 1, 2004. |
