| 1 | A bill to be entitled | 
| 2 | An act relating to public K-12 education; amending s. | 
| 3 | 1003.05, F.S.; allowing children of military personnel | 
| 4 | transferred to Florida after a school year has begun to | 
| 5 | enroll in certain schools or programs in the state; | 
| 6 | providing that a student shall be enlisted for enrollment | 
| 7 | under certain circumstances; providing an effective date. | 
| 8 |

| 9 | Be It Enacted by the Legislature of the State of Florida: | 
| 10 | 
 | 
| 11 | Section 1.  Subsection (2) of section 1003.05, Florida | 
| 12 | Statutes, is renumbered as subsection (3), and a new subsection | 
| 13 | (2) is added to said section to read: | 
| 14 | 1003.05  Assistance to transitioning students from military | 
| 15 | families.-- | 
| 16 | (2)  Children of military personnel who receive military | 
| 17 | orders to transfer to this state after a school year has begun | 
| 18 | shall be allowed to enroll in a school or program included in | 
| 19 | the public school choice options, listed in s. 1002.20(6)(a); in | 
| 20 | a public school that provides exceptional student education; or | 
| 21 | in a public school exceptional student program if they were | 
| 22 | enrolled in such a school or program in the state from which | 
| 23 | they transferred. A school's enrollment deadline shall not | 
| 24 | prevent such student from enrolling in a school or program | 
| 25 | pursuant to this subsection. However, if such student is unable | 
| 26 | to enroll in a school or program pursuant to this subsection due | 
| 27 | to space limitation, such student shall be listed for enrollment | 
| 28 | for the upcoming school term or school year. | 
| 29 | Section 2.  This act shall take effect July 1, 2004. |
