1 A bill to be entitled
2 An act relating to recreational activities at
3 facilities for elderly or disabled adults;
4 authorizing bingo games for residents or
5 clients of certain facilities for the elderly
6 or disabled and for their guests; providing
7 conditions; providing for use of proceeds;
8 providing exemption from local regulation and
9 fees; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Notwithstanding section 849.0931, Florida
14 Statutes, bingo games for residents or clients of facilities
15 licensed or authorized under part II, part III, or part V of
16 chapter 400, Florida Statutes, chapter 651, Florida Statutes,
17 or section 430.206, Florida Statutes, and for their guests, or
18 for residents of government-financed, government-insured, or
19 government-subsidized housing for the elderly and their
20 guests, may be conducted if such games are held in the
21 facility, played exclusively by residents or clients and their
22 guests, and conducted by residents, staff, or volunteers of
23 the facility, and if neither the facility nor any third party
24 derives financial benefit from such games. Games conducted in
25 a facility licensed under part II, part III, or part IV of
26 chapter 400, Florida Statutes, for residents or clients with a
27 diagnosis of Alzheimer's disease or a related dementia may not
28 be played with the personal funds of residents or clients and
29 must be supervised by paid or volunteer staff. Prizes may be
30 claimed only by residents or clients of these facilities or by
31 guests who are residents or clients of other similarly

1 licensed or authorized facilities. Net proceeds must be
2 returned to players in the form of prizes after expenses for
3 refreshments and bingo supplies are deducted. Any county or
4 municipality that regulates the playing of bingo shall exempt
5 bingo games conducted pursuant to this section from regulation
6 and fees.
7 Section 2. This act shall take effect July 1, 2004.

10 SENATE SUMMARY
11 Authorizes bingo games at nursing homes, assisted living
facilities, adult day care centers, intermediate care
12 facilities for the developmentally disabled, multiservice
senior centers, and certain government-financed,
13 government-insured, or government-subsidized housing, for
residents or clients and their guests, if the games are
14 conducted by residents, staff, or volunteers and neither
the facility nor any third party benefits financially.
15 Exempts such games from county and municipal regulation
and fees. Requires supervision of persons with
16 Alzheimer's disease who play bingo and prohibits their
playing with their personal funds. Requires that net
17 proceeds be returned to players in the form of prizes
after expenses for refreshments and bingo supplies are
18 deducted.
