  2         An act relating to trust funds; re-creating the

  3         Lake Okeechobee Protection Trust Fund within

  4         the Department of Environmental Protection

  5         without modification; carrying forward current

  6         balances and continuing current sources and

  7         uses thereof; repealing s. 373.45952(4), F.S.,

  8         relating to termination and review of the trust

  9         fund, to conform; providing an effective date.

11         WHEREAS, the Legislature wishes to extend the life of

12  the Lake Okeechobee Protection Trust Fund within the

13  Department of Environmental Protection, which is otherwise

14  scheduled to be terminated pursuant to constitutional mandate,

15  and

16         WHEREAS, the Legislature has reviewed the trust fund

17  before its scheduled termination date and has found that it

18  continues to meet an important public purpose, and

19         WHEREAS, the Legislature has found that existing public

20  policy concerning the trust fund sets adequate parameters for

21  its use, NOW, THEREFORE,

22  

23  Be It Enacted by the Legislature of the State of Florida:

24  

25         Section 1.  (1)  The Lake Okeechobee Protection Trust

26  Fund within the Department of Environmental Protection, FLAIR

27  number 37-2-890, which is to be terminated pursuant to Section

28  19(f), Article III of the State Constitution on July 1, 2004,

29  is re-created.

 1         (2)  All current balances of the trust fund are carried

 2  forward, and all current sources and uses of the trust fund

 3  are continued.

 4         Section 2.  Subsection (4) of section 373.45952,

 5  Florida Statutes, is repealed.

 6         Section 3.  This act shall take effect July 1, 2004.
