  2         An act relating to trust funds; re-creating the

  3         Florida Forever Program Trust Fund within the

  4         Department of Agriculture and Consumer Services

  5         without modification; carrying forward current

  6         balances and continuing current sources and

  7         uses thereof; repealing s. 589.065(3), F.S.;

  8         abrogating provisions relating to the

  9         termination of the trust fund, to conform;

10         providing an effective date.

12         WHEREAS, the Legislature wishes to extend the life of

13  the Florida Forever Program Trust Fund within the Department

14  of Agriculture and Consumer Services, which is otherwise

15  scheduled to be terminated pursuant to constitutional mandate,

16  and

17         WHEREAS, the Legislature has reviewed the trust fund

18  before its scheduled termination date and has found that it

19  continues to meet an important public purpose, and

20         WHEREAS, the Legislature has found that existing public

21  policy concerning the trust fund sets adequate parameters for

22  its use, NOW, THEREFORE,

23  

24  Be It Enacted by the Legislature of the State of Florida:

25  

26         Section 1.  (1)  The Florida Forever Program Trust Fund

27  within the Department of Agriculture and Consumer Services,

28  FLAIR number 42-2-349, which is to be terminated pursuant to

29  Section 19(f), Article III of the State Constitution on July

30  1, 2004, is re-created.

 1         (2)  All current balances of the trust fund are carried

 2  forward, and all current sources and uses of the trust fund

 3  are continued.

 4         Section 2.  Subsection (3) of section 589.065, Florida

 5  Statutes, is repealed.

 6         Section 3.  This act shall take effect July 1, 2004.
