6An act relating to state vehicles; creating s. 284.311,
7F.S.; requiring certain state employees using state-owned
8vehicles for off-duty work to reimburse the state for
9property damage coverage for such use; requiring the
10Division of Risk Management of the Department of Financial
11Services to adopt rules for such reimbursement and
12insurance coverage; amending s. 287.17, F.S.; construing
13the term "official state business" to permit the use of
14state vehicles by law enforcement officers for going to
15and from lunch breaks and incidental stops for personal
16errands; providing an effective date.

18Be It Enacted by the Legislature of the State of Florida:
19
20     Section 1.  Section 284.311, Florida Statutes, is created
21to read:
22     284.311  Property damage coverage for state-owned
23vehicles.--If a state employee whose duties are those of a law
24enforcement officer, as defined in s. 943.10, uses the motor
25vehicle for off-duty work for which he or she must reimburse the
26state, that reimbursement must include a reimbursement for
27property damage coverage on the motor vehicle while the vehicle
28is used for the off-duty work. The Division of Risk Management
29within the Department of Financial Services shall adopt rules
30assessing the amount of such reimbursement for the actual costs
31of coverage associated with off-duty coverage and may adopt
32rules that provide for a deductible in an amount of not more
33than $500 per incident when the employee is determined to be at
34fault in the incident and was using the motor vehicle in
35approved activities for which he or she was liable to reimburse
36the state.
37     Section 2.  Subsection (3) of section 287.17, Florida
38Statutes, is amended to read:
39     287.17  Limitation on use of motor vehicles and aircraft.--
40     (3)(a)  The term "official state business" may not be
41construed to permit the use of a motor vehicle or aircraft for
42commuting purposes, unless special assignment of a motor vehicle
43is authorized as a perquisite by the Department of Management
44Services, required by an employee after normal duty hours to
45perform duties of the position to which assigned, or authorized
46for an employee whose home is the official base of operation.
47     (b)  For motor vehicles used by a state employee whose
48duties are those of a law enforcement officer, as defined in s.
49943.10, the term "official state business" shall be construed to
50permit the use of the vehicle during normal duty hours to and
51from lunch or meal breaks and incidental stops for personal
52errands, but not substantial deviations from official state
53business, if such use is at the direction of or with the
54permission of the agency head.
55     Section 3.  This act shall take effect July 1, 2004.
