| 14 | state vehicles by law enforcement officers for going to |
| 15 | and from lunch breaks and incidental stops for personal |
| 16 | errands; providing an effective date. |

| 18 | Be It Enacted by the Legislature of the State of Florida: |
| 19 |
|
| 20 | Section 1. Section 284.311, Florida Statutes, is created |
| 21 | to read: |
| 22 | 284.311 Property damage coverage for state-owned |
| 23 | vehicles.--If a state employee whose duties are those of a law |
| 24 | enforcement officer, as defined in s. 943.10, uses the motor |
| 25 | vehicle for off-duty work for which he or she must reimburse the |
| 26 | state, that reimbursement must include a reimbursement for |
| 27 | property damage coverage on the motor vehicle while the vehicle |
| 28 | is used for the off-duty work. The Division of Risk Management |
| 29 | within the Department of Financial Services shall adopt rules |
| 30 | assessing the amount of such reimbursement for the actual costs |
| 31 | of coverage associated with off-duty coverage and may adopt |
| 32 | rules that provide for a deductible in an amount of not more |
| 33 | than $500 per incident when the employee is determined to be at |
| 34 | fault in the incident and was using the motor vehicle in |
| 35 | approved activities for which he or she was liable to reimburse |
| 36 | the state. |
| 37 | Section 2. Subsection (3) of section 287.17, Florida |
| 38 | Statutes, is amended to read: |
| 39 | 287.17 Limitation on use of motor vehicles and aircraft.-- |
| 40 | (3)(a) The term "official state business" may not be |
| 41 | construed to permit the use of a motor vehicle or aircraft for |
| 42 | commuting purposes, unless special assignment of a motor vehicle |
| 43 | is authorized as a perquisite by the Department of Management |
| 44 | Services, required by an employee after normal duty hours to |
| 45 | perform duties of the position to which assigned, or authorized |
| 46 | for an employee whose home is the official base of operation. |
| 47 | (b) For motor vehicles used by a state employee whose |
| 48 | duties are those of a law enforcement officer, as defined in s. |
| 49 | 943.10, the term "official state business" shall be construed to |
| 50 | permit the use of the vehicle during normal duty hours to and |
| 51 | from lunch or meal breaks and incidental stops for personal |
| 52 | errands, but not substantial deviations from official state |
| 53 | business, if such use is at the direction of or with the |
| 54 | permission of the agency head. |
| 55 | Section 3. This act shall take effect July 1, 2004. |
