An act relating to public school student progression; |

amending s. 1008.25, F.S.; requiring the comprehensive |

program for student progression to include assessment of |
5
|
performance in social studies; amending ss. 1003.51 and |
6
|
1003.52, F.S.; conforming provisions relating to subject |
7
|
area grade level proficiency of students in Department of |
8
|
Juvenile Justice education programs; providing an |
9
|
effective date. |

Be It Enacted by the Legislature of the State of Florida: |
12
|
|

|
Section 1. Subsection (1), paragraph (b) of subsection |
14
|
(2), paragraph (a) of subsection (4), and paragraph (a) of |
15
|
subsection (7) of section 1008.25, Florida Statutes, are amended |
16
|
to read: |

|
1008.25 Public school student progression; remedial |
18
|
instruction; reporting requirements.-- |
19
|
(1) INTENT.--It is the intent of the Legislature that each |
20
|
student's progression from one grade to another be determined, |
21
|
in part, upon proficiency in reading, writing, science, social |
22
|
studies,and mathematics; that district school board policies |
23
|
facilitate such proficiency; and that each student and his or |
24
|
her parent be informed of that student's academic progress. |
25
|
(2) COMPREHENSIVE PROGRAM.--Each district school board |
26
|
shall establish a comprehensive program for student progression |
27
|
which must include: |
28
|
(b) Specific levels of performance in reading, writing, |
29
|
science, social studies,and mathematics for each grade level, |
30
|
including the levels of performance on statewide assessments as |
31
|
defined by the commissioner, below which a student must receive |
32
|
remediation, or be retained within an intensive program that is |
33
|
different from the previous year's program and that takes into |
34
|
account the student's learning style. |

|
(4) ASSESSMENT AND REMEDIATION.-- |
36
|
(a) Each student must participate in the statewide |
37
|
assessment tests required by s. 1008.22. Each student who does |
38
|
not meet specific levels of performance as determined by the |
39
|
district school board in reading, writing, science, social |
40
|
studies,and mathematics for each grade level, or who does not |
41
|
meet specific levels of performance as determined by the |
42
|
commissioner on statewide assessments at selected grade levels, |
43
|
must be provided with additional diagnostic assessments to |
44
|
determine the nature of the student's difficulty and areas of |
45
|
academic need. |

(7) ANNUAL REPORT.-- |
47
|
(a) In addition to the requirements in paragraph (5)(b), |
48
|
each district school board must annually report to the parent of |
49
|
each student the progress of the student toward achieving state |
50
|
and district expectations for proficiency in reading, writing, |
51
|
science, social studies,and mathematics. The district school |
52
|
board must report to the parent the student's results on each |
53
|
statewide assessment test. The evaluation of each student's |
54
|
progress must be based upon the student's classroom work, |
55
|
observations, tests, district and state assessments, and other |
56
|
relevant information. Progress reporting must be provided to the |
57
|
parent in writing in a format adopted by the district school |
58
|
board. |

Section 2. Paragraph (c) of subsection (3) of section |
60
|
1003.51, Florida Statutes, is amended to read: |
61
|
1003.51 Other public educational services.-- |
62
|
(3) The Department of Education in partnership with the |
63
|
Department of Juvenile Justice, the district school boards, and |
64
|
providers shall: |
65
|
(c) Maintain standardized required content of education |
66
|
records to be included as part of a youth's commitment record. |
67
|
These requirements shall reflect the policy and standards |
68
|
adopted pursuant to subsection (2) and shall include, but not be |
69
|
limited to, the following: |

|
1. A copy of the student's individual educational plan. |
71
|
2. Assessment data, including grade level proficiency in |
72
|
reading, writing, science, social studies,and mathematics, and |
73
|
performance on tests taken according to s. 1008.22. |
74
|
3. A copy of the student's permanent cumulative record. |
75
|
4. A copy of the student's academic transcript. |
76
|
5. A portfolio reflecting the youth's academic |
77
|
accomplishments while in the Department of Juvenile Justice |
78
|
program. |

Section 3. Subsection (7) of section 1003.52, Florida |
80
|
Statutes, is amended to read: |

|
1003.52 Educational services in Department of Juvenile |

|
Justice programs.-- |

|
(7) An academic improvement plan shall be developed for |
84
|
students who score below the level specified in district school |
85
|
board policy in reading, writing, science, social studies,and |
86
|
mathematics or below the level specified by the Commissioner of |
87
|
Education on statewide assessments as required by s. 1008.25. |
88
|
These plans shall address academic, literacy, and life skills |
89
|
and shall include provisions for intensive remedial instruction |
90
|
in the areas of weakness. |

|
Section 4. This act shall take effect July 1, 2004. |
